RESOLUTION NO. R-96-24
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
DENYING AN EXTENDED HOURS PERMIT
REQUESTED BY PETER MIDDLETON TO
PERMIT THE SALE AND CONSUMPTION OF
ALCOHOLIC BEVERAGES UNTIL 4:00 A.M.
AT 6303 WEST COMMERCIAL BOULEVARD
D/B/A KANGAROO DOWNS LOCATED IN
THE HOTZ PLAZA ON THE NORTH SIDE OF
WEST COMMERCIAL BOULEVARD, EAST
OF NW 64 AVENUE; PROVIDING FOR
CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFEEQTIVE
WHEREAS, the Code of the City of Tamarac provides for the denial of an Extended
Hours Permit to permit the sale and consumption of alcoholic beverages until 4:00 A.M. at
6303 West Commercial Boulevard d/b/a Kangaroo Downs located in the Hotz Plaza on the
north side of West Commercial Boulevard, east of NW 64 Avenue; and
WHEREAS, the City Commission of the City of Tamarac has enacted Chapter 3,
Section 3-5(d) and (e) which sets forth stringent requirements and criteria before granting
approval for an extended hours special permit; and
WHEREAS, the City Commission of the City of Tamarac finds that the Extended
Hours Permit would not be in keeping with the public health, safety and general welfare of
the City of Tamarac; and

WHEREAS, the Director of Community Development recommends denying this
request by Peter Middleton d/b/a Kangaroo Downs to permit the sale and consumption of
alcoholic beverages until 4:00 A.M.; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to deny an Extended
Hours Permit requested by Peter Middleton to permit the sale and consumption of alcoholic
beverages until 4:00 A.M. at 6303 West Commercial Boulevard d/b/a Kangaroo Downs
located in the Hotz Plaza on the north side of West Commercial Boulevard, east of NW 64
Avenue.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the request by Peter Middleton to grant an Extended
Hours Permit to permit the sale and consumption of alcoholic beverages until 4:00 A.M. at
6303 West Commercial Boulevard d/b/a Kangaroo Downs located in the Hotz Plaza on
the north side of West Commercial Boulevard, east of NW 64 Avenue, is hereby denied.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
