R-96 .- 2-81 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE FUNDING OF BID NO. 96-18 IN THE AMOUNT OF $119,226.00 FROM PARKS AND RECREATION IMPACT FEES FUND; APPROVING THE AWARD OF BID NO. 96-18 ENTITLED "TAMARAC PARK CONCESSION STAND REPLACEMENT" TO ATLANTIC COASTAL CONSTRUCTION OF DAVIE, FLORIDA FOR DEMOLITION OF THE EXISTING CONCESSION STAND AND REPLACING IT AT TAMARAC PARK AT 7501 UNIVERSITY DRIVE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac publicly advertised Bid No. 96-18 for construction of the Tamarac Park Concession Stand Replacement at 7501 University Drive in the Sun - Sentinel on October 13 and 20, 1996 ; and WHEREAS, on November 4, 1996 four (4) bids were opened: (1) Acutec, Inc. $159,075.00 (2) Leadex Corporation $136,860.00 (3) Atlantic Coastal Construction $119,226.00 (4) Lobban Construction, Inc. $147,887.00 WHEREAS, Atlantic Coastal Construction of Davie, Florida submitted the lowest bid proposal at $119,226.00; and WHEREAS, funding in the amount of $119,226.00 from Parks and Recreation Impact Fees Fund; and Temp. Reso. # 7608 Page 2 Revision #1 - 11/19/96 WHEREAS, it is the recommendation of the Director of Public Works, City Engineer, Parks and Recreation Director, and Purchasing/Contracts Manager that Bid No. 96-18 be awarded to the lowest responsive and responsible bidder, Atlantic Coastal Construction of Davie, Florida; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve the award of Bid No. 96-18 for the replacement of the Concession Stand at Tamarac Park for an amount of $119,226.00 to Atlantic Coastal Construction of Davie, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SE TI N 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution . SECTION 2: That the funding for Bid No. 96-18 from Parks and Recreation Impact Fees Fund is HEREBY APPROVED. SECTION 3: That the award of Bid No. 96-18 to Atlantic Coastal Construction of Davie, Florida is HEREBY APPROVED. SECTION 4: That the City Manager or his designee BE AUTHORIZED to close the bid award including but not limited to making final payment and releasing bonds when the work has been successfully completed within the terms and conditions of the Contract Documents. P Temp. Reso. # 7608 Page 3 Revision #1 - 11/19/96 SECTION 5: That all resolutions or parts of resolutions in conflict herewith are HEREBY REPEALED to the extent of such conflict. SECTION 6: That if any clause, section, other part or application of the Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 7: That this Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this / 1 ATTEST: CAROL.
