RESOLUTION NO. R-96 - q 0
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO ACCEPT AND
EXECUTE A QUIT CLAIM DEED FOR TWO (2)
PARCELS AND A TEMPORARY CONSTRUCTION
EASEMENT, BOTH LOCATED IN CITY CANAL RIGHT-
OF-WAY, FOR THE WIDENING OF MCNAB ROAD BY
BROWARD COUNTY (PROJECT NO. 5117) FROM
UNIVERSITY DRIVE TO PINE ISLAND ROAD;
PROVIDING FOR CONFLICT; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Broward County is in the process of causing McNab Road to be
widened between University Drive and Pine Island Road; and
WHEREAS, the construction of this project requires an additional two -foot wide
strip of right-of-way and a five-foot wide temporary construction easement, both located
in the City canal right-of-way on the north side of McNab road just east of NW 89th
Avenue; and
WHEREAS, it is the recommendation of the City Engineer that the two (2) parcels
be Quit Claimed to Broward County and the Temporary Construction Easement be
granted to Broward County; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it in the
best interest of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to accept and execute the Quit Claim Deed and Temporary
Construction Easement.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
5-e&i4n 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution.
Section 2: That the appropriate City Officials are hereby authorized to accept
and execute the Quit Claim Deed and Temporary Construction Easements, copies of
which are attached hereto as "Composite Exhibit A".
Section : That if any clause, section, or part of application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portion or application of this
Resolution.
Section 4: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.

Section 5: This resolution shall become effective immediately upon its passage
and adoption.

19t, by and between the undersigned City of Tamarac,Florida'
as GRANTOR and BROWARD COUNTY as GRANTEE.
WHEREAS, the Grantee, through its Contractor or its Road Department,
proposes to construct an improvement known as

WHEREAS, the construction of said improvement will use the entire right of
way; and
WHEREAS, in order that the abutting lands of the undersigned Grantor
may conform, tie and harmonize with the said construction, it will be necessary
to slope or grade a portion of said abutting lands of the Grantor;
NOW, THEREFORE, WITNESSETH; That for and in consideration of the
benefits accruing or to accrue by reason of the construction of said improve-
ment and by reason of said sloping or grading on said Grantor's abutting lands,
the undersigned hereby grant(s) unto the said Grantee an easement to enter
upon and slope or grade, either by fill or cut, as may be prescribed by the
construction plans of the said improvement, the abutting lands of the Grantor,
lying and being in Broward County, Florida; described as follows:
The legal descriptions are attached hereto and made partof. The
description describes two parcels of land known as 98 TCE and 99 TCE
of Project 5117 McNab Road - Pine Island to University Drive.
The sloping or grading not to extend beyond a distance of 10
feet from the Northerly right of way line of McNab Road

THIS EASEMENT is granted upon the condition that the sloping and/or
grading upon the above land shall not extend beyond the limits outlined above
and that all grading or sloping shall conform to all existing structural improve-
ments within the limits designated, and all work will be performed in such
manner that existing structural improvements will not be damaged.
THIS EASEMENT shall expire upon the completion of the construction of
the said road project.
