RESOLUTION NO. R 96-
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA APPROVING THE PURCHASE OF
WATER METERS FROM PRECISION METERS
INCORPORATED, UTILIZING CITY OF HIALEAH BID
ENTITLED "MULTI -JET TYPE WATER METERS" AT AN
ESTIMATED COST OF $38,300.00, APPROVING FUNDING
OF$33,300.00 FROM ACCOUNT 425-888-533-67D
ENTITLED "METER REPLACEMENT PROGRAM", AND
$5,000.00 FROM ACCOUNT 425-365-533-670 ENTITLED
"METERS, METER BOXES"; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, City of Hialeah Bid entitled "Multi -Jet Type Water Meters" was awarded
to Precision Meters Incorporated on September 21, 1994, and expires on November 3,
1996; and
WHEREAS, City Code §6-154 allows the Purchasing Officer the authority to join
with other units of government in cooperative purchasing when the best interest of the City
would be served; and
WHEREAS, it is the recommendation of the Utilities Director and the Purchasing
Officer that the purchase be awarded to Precision Meters Incorporated; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to approve the
purchase of water meters from Precision Meters Incorporated.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION : The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this resolution.
SECTION 2: That the purchase of water meters at an estimated cost of
$38,300.00 IS HEREBY APPROVED to be purchased from Precision Meters Incorporated.
SECTION 3: Funding for the purchase is budgeted under Account 425-888-
533-67D entitled "Meter Replacement Program" $33,300.00 and Account 425-365-533-670
entitled "Meters, Meter Boxes" for $5,000.00.
SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

ADVERTISEMENT FOR BIDS
Sealed proposals for the FURNISHING OF MULTI -JET TYPE WATER METERS,
SIZES 5/8" X 3/411; 1"; 1 1/211; AND 2" will be received by the Water
and sewer Board of the Department of water and Sewers, City of
Hialeah, Florida, at its regular place of meeting, 3700 West 4
Avenue, Hialeah, Florida, until 6:30 P.M., Wednesday, September 7,
1994, at which time the bids will be opened and read aloud. Bids
received attar said time will be returned unopened.
Specifications may be obtained from the offices of the Department
of Water and sewers, 3700 West 4 Avenue, Hialeah, Florida.

INFORMATION FOR BIDDERS
1. Preparation of Bids
1.1 Bids must be submitted upon the prescribed forms. All
blank spaces must be filled in as noted, in ink, or
typed. Figures shall have amounts extended and totaled,
and no changes shall be made in the phraseology of the
forms or in the items mentioned therein. Any bid may be
deemed informal which contains any omissions, erasures,
alterations, additions, irregularities of any kind, or
items not called for, or which does not contain prices
set opposite to each of the several items in the bid form
or in which any Of the prices are obviously unbalanced,
or which shall in any manner Pail to conform to the
conditions of the published notice inviting bids.
1.2 if the bid is made by a corporation, the name and address
of the corporation shall be shown together with the names
and addresses of the Officers. if the bid is made by a
corporation it must be acknowledged by one of the
officers thereof.
2. Receipt and Opening
Of Bids
Sealed bids will be received as stated in the "Advertisement for
Bids" and then publicly opened and read aloud. Bids shall be made
on the forms enclosed and submitted in a sealed envelope addressed
to Mr. Jack L. Haygood, Director, Department of Water and Sewers,
3700 West 4 Avenue, Hialeah, Florida 33012, and endorsed with the
name of the bidder and the project title on the outside of the
envelope.
3. F-O.B. Point
The bid price for each item of the "Proposal & Specifications"
shall include furnishing the product(s) F.O.B. Hialeah Department
y of Water & Sewer Yard, 465 West 37 Street, Hialeah, Florida 33012.
The Owner will arrange for unloading.
4. Tax Exemptions
The City of Hialeah, Florida is exempt from State and Federal Sales
and Use Taxes. Exemption number will be provided to the supplier
When the contract is awarded.

5. Right to Accept and Reject Bids
The Owner reserves the unqualified right in the Owner's sale and
absolute discretion, to reject any and all bids or to accept that
bid or combination of bids, which in the Owner's sole and absolute
judgement, will under all circumstances, best serve the public
interest.
6_ Acceptance of Bid and Award of contract
Within thirty (30) days after opening of the bids, the owner will
accept one of the rids or will act in accord with paragraph 5 of
this "Information for Bidders." The acceptance of the bid will be
by notice in writing signed by the Owner or his representative,
mailed to or delivered at the office designated in the bid.
7. The quantities shown for each item are for bid comparison
only, and the gepartment of Water and Sewers does not guarantee
that any quantity of the bid items shall be purchased. Prices on
bid shall be the prices to be charged during the life of the
contract. contract shall be in effect for a period of two years.
The present contract for meters expires on November 3, 1992, and
this contract will become effective after that date.

Pursuant to and in compliance with your Advertisement for
Bids, the information for Bidders and other Contract Documents
relating thereto, the undersigned hereby proposes to furnish all
labor, equipment and materials and perform all work necessary for
the+ furnishing of supplies, all as required by and in strict
accordance with the Proposal and Specifications, Advertisement for
Bids, information for Bidders, and General Conditions, all of which
are attached hereto.
The undersigned, as Bidder (herein used in the masculine
singular irrespective of actual gender and number), hereby declares
that the only persons interested in this Proposal are named herein;
that no other person has any interest in this Proposal or in the
Contract to which this Proposal Pertains; that this Proposal is
made without connection or arrangement with any other person, and
that this Proposal is in every respect fair, in good faith and
without collusion or fraud,
The Bidder further declares that he has complied in
every respect with all the instructions to Bidders; that he has
read all addenda issued prior to the opening of bids, and that he
has satisfied himself fully relative to all matter's and conditions

The Bidder proposes and agrees, if any portion of this
Proposal is accepted, to accept a Purchase Order for all products

„ The City of Hialeah through Ordinance No.'89-56, approved
on May 9, 1989, required Disclosure Affidavits from vendors. All
contracts or business transactions in excess of one hundred dollars
($100.00) with the Department of Water and Sewers of the City of

GENERAL CONDITIONS
1. Definitions and Terms
Abbreviations used in these specifications refer to the following.
OWNER: Department of Water and Sewers, City of Hialeah, Florida,
SUPPLIER/BIDDER• The person, firm or corporation to whom this
Contract is awarded by the owner. The Supplier shall be considered
independent and not an agent of the owner.
CONTRACT/PROPOSAL: The agreement executed by the Owner and the
Supplier.
SPECIFICATIONS: The detailed description of the item,
2.- Notice to Ship
When the Proposal has been accepted by the owner, a Contract will
be forwarded to the Supplier. A Purchase Order will, be issued as
items are required.
3. Delivery ,
The Supplier will complete delivery within the days specified in
the Proposal, unless extensions of time have been requested of and
granted in writing by the Owner. All product s) furnished under
this Contract shall be shipped F.O.B., Hialeah Department of Water
& Sewer Yard, 465 West 37 street, Hialeah, Florida 33012. Bills of
lading or notices of shipment shall be sent to the Owner in
sufficient time to allow him to make arrangements for unloading and
storage. If the supplier does not fulfill his delivery of
product(s) within the time allotted in the Contract Documents,
then the Owner reserves the right to purchase the product(s) from
an alternate supplier. Any additional costs (direct or indirect)
incurred by the owner in purchasing product(s) from an alternate
supplier shall be at the expense of the Supplier who is not
Fulfilling the terms of his Contract with the Owner.
4. Extension of Time
The Owner reserves the right to grant an extension of time to the
Supplier for any delay in complete delivery that is, in their
judgement, beyond the control of the supplier, which may be caused
by acts of God, strikes or other condition that the owner may
consider unavoidable.

5. Inspection
All product(s) will be thoroughly inspected upon delivery to
determine specifications conformance.

7. Patents
The Supplier shall hold and save the owner and its officers,
agents, servants and employees harmless from liability of any
nature or kind, including cost and expenses for or on account of
any patented or unpatentad invention, process, article or appliance
manufactured or used in the performance of the Contract, including
its use by the owner unless otherwise specifically stipulated in
the Contract Documents.
8. Assignments
The Supplier shall not assign the whole or any part of this
Contract or any monies due or to become due hereunder, without
written consent of the owner. In case the supplier assigns all or
any part of any monies due or to become due under the contract,
the instrument of assignment shall contain a clause substantially
to the effect that it is agreed that the right of the assignee in
and to any monies due or to become due to the Supplier shall be
subject to prior liens of all persons, firms and corporations for
services rendered or product(s) supplied for the performance of the
work called for in this Contract,
9. It is the intent of these specifications that ALL meter
manufacturers be permitted to bid on their multi-jst cold water
meters. It is expected that all product(s) furnished meet all
provisions of the specifications. In the event that the product
does not meet all the specifications, the Bidder will indicate any
and all deviations from the specifications in the space provided
on the Proposal. for deviations. The submittal of catalog cuts or
product numbers does not meet the requirements for listing
deviations. it will be the Bidder's responsibility to list and
submit sufficient data for evaluation on all items not fully
meeting the specifications. If there are no deviations indicated
in the proposal, the Bidder will be required to furnish a product
meeting all elements of the specifications. The Department
reserves the right to determine if the substitute items fully meet
