R-96 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE THE THIRD AMENDMENT TO THE WATER AND SEWER DEVELOPER'S AGREEMENT WITH PULTE HOME CORPORATION FOR PLUM BAY -PLUM HARBOR LAND SECTION 8 (MULTI- FAMILY RESIDENCE); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Pulte Home Corporation, developer of the Plum Bay -Plum Harbor Land Section 8 (Multi -Family Residence) Project located north of Commercial Boulevard between Nob Hill Road and N.W. 94th Avenue (shown in map form as "Exhibit 1") has revised the original Site Plan; and WHEREAS, the developer executed a Water and Sewer Developer's Agreement on September 22,1993 for this Project; and WHEREAS, the revised Site Plan changed the number of residential connections to 292 units requiring changes to "Exhibit D" and the Phase Schedule of the previous Agreement and Amendments; and 1 1 Temp. Reso. # 7247 WHEREAS, the developer has offered a Third Amendment to the Water and Sewer Developer's Agreement to establish the requirement for 292 ERC's for water and for sewer and require the total payment of $804,640 in CIAC Fees of which the Developer has paid $168,055; and WHEREAS, the Third Amendment to the Water and Sewer Developer's Agreement establishes a Phase Schedule for the payment of CIAC Fees before Building Permits are issued in accordance with City Code Section 10 - 101; and WHEREAS, it is the recommendation of the Director of Utilities that this Third Amendment to the Water and Sewer Developer's Agreement between the City of Tamarac and Pulte Home Corporation for the Plum Bay -Plum Harbor Land Section 8 (Multi -Family Residence) be approved and executed; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to accept and execute a Third Amendment to the Water and Sewer Developer's Agreement from Pulte Home Corporation for the Plum Bay -Plum Harbor Land Section 8 (Multi -Family Residence). 2 1 Temp. Reso. # 7247 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: That the appropriate City Officials are hereby authorized to accept and execute a Third Amendment to the Water and Sewer Developer's Agreement with Pulte Home Corporation for Plum Bay -Plum Harbor Land Section 8 (Multi -Family Residence)(attached hereto as Exhibit "2"). SECTION 3: That the City Clerk is hereby authorized and directed to record said agreement in the public records of Broward County. SECTION 4. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. $ACTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 3 Temp. The obligation of the CITY to furnish water and/or sewer service other than construction water shall not arise until DEVELOPER has completed the conditions contained in this paragraph. The CITY shall reserve 292 ERC's of water service and 292 ERC's.of sewage treatment plant capacity for DEVELOPER. 3. All other provisions of the Developer's Agreement are hereby ratified. 4.
