A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, APPROVING THE TRANSFER OF
$36,100.00 FROM ACCOUNT NUMBER 432-888-535-674
ENTITLED "LAND SECTION 7 SOUTH PUMP STATION 47" TO
ACCOUNT NUMBER 432-363-533-6HK ENTITLED
"EXTENSIONS AND MODIFICATIONS"; APPROVING CHANGE
ORDER NO. 1 AT A COST OF $36,100.00 TO THE CONTRACT
WITH MCCAROL PARTNERS, INC. ENTITLED "WATER MAIN
EXTENSION ON MCNAB, NOB HILL ROAD AND 108TH
TERRACE," FUNDED UNDER ACCOUNT NUMBER 432-363-533-
6HK ENTITLED "EXTENSIONS AND MODIFICATIONS";
AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO
EXECUTE CHANGE ORDER NO, 1 BETWEEN THE CITY OF
TAMARAC AND MCCAROL PARTNERS, INC.; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac awarded Bid Number 95-02 on May 24, 1995 to McCarol
Partners, Inc. as the lowest responsive and responsible bidder for the construction of a 16" water
main extension located on portions of McNab Road, Nob Hill Road and Northwest 108th Terrace
(shown in map form as "Exhibit 1") at a cost of $465,670.89; and
WHEREAS, in the course of the construction, additional work was required to address
underground utilities conflicts, to extend the watermain an additional 350 feet north of the
Westwood Drive tie-in, and to meet Broward County Engineering and traffic safety requirements;
and

WHEREAS, the Utilities Engineer approved these changes in the interest of job continuity
and safety before a total cost was received; and
WHEREAS, the cost of the extra work when presented by the contractor in Change Order
No. 1 (attached hereto as "Exhibit 2") exceeded the bid price of the contract by $36,100.00; and
WHEREAS, by City Code Sec. 6-156, all change orders over $10,000.00 must be pre -
approved by City Commission; and
WHEREAS, funds are available in Account Number 432-888-535-674 entitled "Land
Section 7 South Pump Station 47" (a CIAC funded project) and can be transferred to Account No.
432-363-533-6HK entitled "Extensions and Modifications," to fully fund Change Order No. 1; and
WHEREAS, it is the recommendation of the Director of Utilities that the Change Order No.
1 be funded, accepted and executed; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best
interest of the citizens and residents of the City of Tamarac to approve a transfer of $36,100.00
from Account Number 432-888-535-674 entitled "Land Section 7 South Pump Station 47" to
Account Number 432-363-533-6HK entitled "Extensions and Modifications" and to approve the
acceptance and execution of Change Order No. 1 to the contract for the 16" water main
extension to McCarol Partners, Inc. at a cost of $36,100.00.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this resolution.
SECTION 2: That the appropriate City Officials are hereby authorized to approve a
transfer of $36,100,00 from Account Number 432-888-535-674 entitled "Land Section 7 South
Pump Station 47" to Account Number 432-363-533-6HK entitled "Extensions and Modifications"
to fully fund Change Order No. 1.
SECTION 3, That Change Order No. 1 to the contract for the 16" water main extension
on Nob Hill, McNab and Northwest 108th Terrace is hereby approved and that the appropriate
officials are authorized to execute Change Order No.1 between the City of Tamarac and McCarol
Partners, Inc.
SECTION 4: That the City Manager or his designee be authorized to make changes,
close the bid award including but not limited to making final payment and releasing bonds when
the work has been successfully completed within the terms and conditions of the contract and
within the bid price and Change Order No. 1.
SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.

SECTION 6: If any clause, section, other part or application of this Resolution is held
by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it
shall not affect the validity of the remaining portions or applications of this Resolution.
SECTION 7: This Resolution shall become effective immediately upon its passage and
adoption.
