R-96. b A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE DESIGN OF TAMARAC'S EMERGENCY MEDICAL SERVICES SYSTEM EFFECTIVE OCTOBER 1, 1996 AND AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO ENTER INTO CONTRACT NEGOTIATIONS WITH MEDICS AMBULANCE SERVICES, INC. FOR SUPPLEMENTAL EMERGENCY MEDICAL SERVICES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac is currently part of the Broward County emergency medical services (EMS) system and the County announced that it will be changing the structure of this system effective October 1, 1996; and WHEREAS, upon being notified of the coming change, the City began a process of studying alternatives of how the City should provide advanced life support (ALS) 1st responder and ALS transport services; and WHEREAS, this process has included in-depth discussion during FY 96 Budget planning, a Request For Proposals (RFP) process, and in-depth discussions subsequent to the RFP process; and WHEREAS, the outcome of this formal ten month process indicates the best option for the delivery of emergency medical services is for the City to create its own system with the Tamarac Fire Department providing the majority of services with significant support from a private sector provider; and WHEREAS, the City Commission on the 27th day of March, 1996, adopted Resolution No. R-96-68 amending the annual budget for fiscal year 1996 which added thirteen positions, funding for three ambulance units, and associated equipment to the Tamarac Fire Department for the purpose of providing emergency medical services; and WHEREAS, the estimated annualized cost for the changes to the Fire Department made by the Midyear Budget Amendment is $890,000 which will be partially offset by an estimated $400,000 in emergency transport revenue to be collected by a third party on behalf of the City; and WHEREAS, these additions provide the Tamarac Fire Department the ability to respond as the sole provider of emergency medical services the majority of the time, but not all the time; and TEMP. RESO. # 7399 April 18, 1996 WHEREAS, the City has made its needs and system requirements known to private providers through the RFP process and subsequent negotiations; and WHEREAS, City administration has discussed proposals and options for supplemental service with Medics Ambulance Services and LifeFleet Atlantic Ambulance and has determined that the inclusion of a subscription program (that may retire the annual debt payment for two ambulances) distinguishes the Medics proposal; and WHEREAS, Medics Ambulance Services, Inc. has offered to meet the City's needs and requirements which include specific response times, specific staffing levels, City protocols, and a cash performance bond; and WHEREAS, it is the recommendation of the City Manager that Medics Ambulance Services, Inc. be selected; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve the design of Tamarac's Emergency Medical Services System effective October 1996 and to authorize the appropriate City officials to enter into contract negotiations with Medics Ambulance Services, Inc. for supplemental emergency medical services. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. Section 2: The design of Tamarac's Emergency Medical Services System which includes resources to operate two City emergency advanced life support transport units and two emergency advanced life support non -transport units (first responders) with the addition to the Fire Department of three shift managers, one EMS division manager, nine firefighter/paramedics, up to three ambulance units, associated equipment and the provision for supplemental services by Medics Ambulance Services, Inc., is hereby approved. Section 3: The supplemental Emergency Medical Services proposal of Medics Ambulance Services, Inc., which was arrived at through a competitive negotiation process and represented verbally to the City Commission, is hereby accepted and the appropriate City officials are authorized to negotiate a contract detailing the specifics of this proposal provided that the final product includes, among other items: commitment to a six minute response time 90% of the time (fractal measurement) for first responder and a ten minute response time 90% of the time (fractal measurement) for transport; services supplied through non -dedicated units with a minimum staffing level of 1 paramedic and 1 2 TEMP. RESO. # 7399 April 18, 1996 emergency medical technician per unit; agreement to abide by City of Tamarac medical protocols; agreement that the City shall have full access to company records concerning emergency calls responded to within Tamarac; agreement that the City and the company will each be responsible for billing for their respective services at rates determined by the City; agreement to post with the City a $100,000 cash performance security; agreement that the City will have approval or veto authority over subscription program expenses; agreement that the City has the right to terminate the contractual relationship upon City's determination of inadequate performance on the part of the private provider. Section 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are declared to be severable. Section 6: This Resolution shall become effective immediately upon its passage and adoption.
