CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-96- T5
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA AMENDING RESOLUTION NO.
R-94-34 PROVIDING FOR MODIFIED TERMS OF
EMPLOYMENT FOR CITY MANAGER ROBERTS. NOE, JR.;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, since February 28, 1994 Robert S. Noe, Jr. has been employed as City
Manager; and
WHEREAS, on April 29, 1996 the City Commission expressed interest in amending
the terms of the City Manager's employment; and
WHEREAS, the City Commission desires to provide the following: increase of
salary to $95,000 per year; increase in car allowance to $700.00 per month;
implementation of a 401(a) money purchase retirement plan with a contribution of ten
(10%) percent of annual salary with the City Manager contributing a minimum of five (5%)
percent of annual salary; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to modify the
compensation terms for the City Manager.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and

confirmed as being true and correct and are hereby made a specific part of this Resolution.
S-ELTION : Section 1, paragraph 2 of Resolution No. 94-34 will be amended as
set forth below:

"Effective with the first pay period in January, 1996, NOE will
receive a salary of Ninety -Five Thousand Dollars ($95,000.00) per
year, payable in twenty-six (26) installments at such pay periods
as all other City employees are paid."
Section 1, paragraph 3 of Resolution No. R-94-34 will be amended as
"Effective with the first pay period in June, NOE shall receive a
monthly car allowance of Seven Hundred Dollars ($700.00), to be
paid the first pay period of each month."
- TION 4: Section 1, paragraph 22 of Resolution No. R-94-34 will be added as
set forth below:
"Pursuant to Commission action authorizing the approved 401(a)
money purchase retirement plan. It shall be made available to
NOE and administered by the ICMA Retirement Corporation. The
City shall contribute ten (10%) percent and NOE shall contribute
a minimum of five (5%) percent of NOE's annual salary towards
the retirement plan per year."
SECTIQN 5: Section 1, paragraph 23 of Resolution No. R-94-34 will be added as

"After approval by the Commission, consistent with Resolution
No. R-94-34, NOE will agree by signature to a letter accepting the
amended terms."
SEQTION 6: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 7: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SE N : This Resolution shall become effective immediately upon its passage
and adoption.
