R-95- % %5 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMAR,,kC, FLORIDA REQUESTING THE BROWARD COUNTY COMMISSION TO ISSUE ACERMFICATE OF NEED CLASS 1 LICENSE NOW, TO BE EFFECTIVE OCTOBER 1, 1996 IF THE CITY OF TAMARAC CHOOSES TO PROVIDE EMERGENCY MEDICAL TRANSPORT SERVICES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE, WHEREAS, on May 9, 1995 the Broward County Commission awarded the City of Tamarac a Class 8 Certificate of Need (CON) License; and WHEREAS, the Class 8 License permits the City to provide Advanced Life Support First Responder Service with City fire equipment and personnel; and WHEREAS, on June 12, 1995 the City Commission of Tamarac discussed the CON Class 1 Certificate; and WHEREAS, the CON Class 1 Certificate allows the City of Tamarac to provide emergency medical transport services; and WHEREAS, the City Commission of Tamarac requests the Broward County Commission to issue a CON Class 1 License now, to be effective October 1, 1996 if the City chooses to provide emergency medical transport services; and WHEREAS, the City Commission of Tamarac will advise the Broward County 2 Temp. Reso. #7115 Revised 9/12/95 Administrator of Tamarac's choice of service delivery prior to September 30, 1995; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to receive the CON Class 1 Certificate of Need until a final decision is made on how the City will proceed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission of Tamarac requests the Broward County Commission to issue a CON Class 1 License now, to be effective October 1, 1996. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption. 1 u fl JI, 3 Temp.
