CITY OF TAMARAC
RESOLUTION NO. R-95- 1/3
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, APPROVING $10,000.00 FROM
PARKS AND RECREATION IMPACT FEES FOR THE
CONSTRUCTION OF A COVERED WALKWAY BETWEEN
TAMARAC ELEMENTARY SCHOOL AND THE MULTI-
PURPOSE CENTER AT TAMARAC PARK; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, a covered walkway between Tamarac Elementary School and the
Multi -Purpose Center at Tamarac Park would be of substantial benefit, especially during
inclement weather, to those children using this walkway on a daily basis; and
WHEREAS, the construction of this covered walkway will be a Broward County
School Board project, these funds, not to exceed $10,000.00, are appropriated as the
City of Tamarac's fair share portion; and
WHEREAS, the City Attorney has determined that this project meets the
requirements controlling the use of Parks and Recreation Impact Fees; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be
in the best interest of the citizens and residents of the City of Tamarac to construct this
covered walkway.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution.
Section 2: The construction of a covered walkway between Tamarac Elementary
School and the Multi -Purpose Center at Tamarac Park is approved provided the project
is contracted and overseen by the Broward County School Board and the cost of the
City of Tamarac's portion does not exceed $10,000.00.
Section 3: The City Manager, or designee, is authorized to make appropriate
arrangements between the City of Tamarac and the Broward County School Board
concerning the construction of this walkway and subsequent payment to the Broward
County School Board for the City's fair share.

Section 4: For proper accounting purposes, funds will be transferred from
account 142-888-572-99C entitled "Resources Available" to account 142-872-572-630
entitled "Improvements Other Than Buildings."
Section 5: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
Section 6: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
Section 7: This Resolution shall become effective immediately upon its passage
and adoption.
