RESOLUTION NO. R-95- 1,2-6
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, REPEALING RESOLUTION NO.
95-13 AND AUTHORIZING LUTZ PETROLEUM
INSTALLATION, INC. TO PERFORM THE TANK REMOVAL
AND REPLACEMENT AT THE TRACT 27 SITE BY
INSTALLING A 2,000 GALLON CONVAULTABOVEGROUND
DIESEL STORAGE TANK, AND REMOVE AND DISCARD
THE ABANDONED 1,000 GALLON ABOVEGROUND STEEL
STORAGE TANK AND GENERATOR MUFFLER AT THE
WATER TREATMENT PLANT SITE BY UTILIZING THE PALM
BEACH COUNTY SCHOOL BOARD BID AT A TOTAL COST
OF $40,550.00; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of Tamarac has three current diesel storage tanks used to
fuel emergency power generating equipment at each potable water storage tank site
and one abandoned tank and generator muffler from the old sewage treatment facility
that must be properly discarded; and
WHEREAS, the current diesel storage tank located at the Tract 27 potable water
storage tank site is the only one of the underground type and underground diesel fuel
storage tanks are no longer permitted because they create a potential for contamination

of the surrounding soil and in -ground tanks must be removed and replaced with an
aboveground unit; and
WHEREAS, provisions in current storage tank regulations allow project
completion by direct contractor service without the need of additional consultant
service fees thereby removing the need for Resolution No. 95-13 for project design
fees; and
WHEREAS, Lutz Petroleum Equipment Installation, Inc. has offered to extend
the terms and conditions of the Palm Beach County School Board Bid to the City of
Tamarac for the Tract 27 Underground Tank Removal Project completion; and
WHEREAS, the City Commission approved funding for this project in the FY95
Budget under Account Number 425-888-533-671, entitled "Tract 27 Fuel Containment
Structure" in the amount of $56,000.00; and
WHEREAS, the complete tank replacement project cost will be $40,550.00 and
is funded under Account No. 432-888-433-671 entitled "Tract 27 Fuel Containment
Structure"; and

WHEREAS, it is the recommendation of the Utilities Director that the City
Commission repeal Resolution R-95-13 and authorize Lutz Petroleum Installation, Inc.
to complete the Tract 27 Tank Replacement Project; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be
in the best interest of the citizens and residents of the City of Tamarac to repeal
Resolution No. R-95-13 for tank replacement design and authorize Lutz Petroleum to
provide their services for project completion of Tract 27 Fuel Containment Structure
Replacement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
resolution.

SECTION 2: That Lutz Petroleum Equipment Installation is authorized to
install a 2,000 gallon convault diesel tank and to remove the existing diesel tank and an
abandoned 1,000 gallon aboveground diesel storage tank and large generator muffler
from the Water Treatment Plant site at a cost of $40,550.00 under the terms and
conditions of the Palm Beach County School Board Bid.
SECTION 3: Resolution No. 95-13 attached hereto is repealed in its
entirety.
SECTION 4: Lutz Petroleum will secure all necessary permits prior to
beginning work.
SECTION 5: All Resolutions or parts of Resolutions in conflict herewith
are hereby repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining portions or
applications of this Resolution.

OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO ENTER INTO AN
AGREEMENT WITH WILLIAMS, HATFIELD AND STONER,
FOR THE DESIGN, SIDDING, PERMITTING AND
CONSTRUCTION DOCUMENTS FOR THE REPLACEMENT'
OF THE WATER MAIN LOCATED ON PINE ISLAND ROAD
FROM N.W. 57TH STREET TO 350 FEET NORTH OF
LAGOS DE CAMPO BLVD; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac, Florida deem it to be
in the best interest of the citizens and residents of the City of Tamarac to acaept'and
execute Work Authorization No. 6 to the Enghw0 ling Agreemerrt with Wiliam, HatAeld
and Stonerfor the design, bidding, permitting and construction documents for the
installation of 2900' of IV D,I,P, for the Pine island Water Main Replacement; and
MiEREAS, The Ck of Tamarac is required to remove the existing 12" A;C.P.
water main to conform with Broward County Road Paving Requirements and Pine
Island Road Improvements: and
VyHF.REAS, It is recommendation of the Utilities Director that Work Authorization
No. 6 providing for the design, bidding, permitting and construction documents for the
Pine island Water Main Replacement be approved and executed.

replacement, for an amount not to exceed $36,400 to be funded from Account No.425-
888-533-67, E, "PINE ISLAND WATER MAIN REPLACEMENT".
