A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO APPLY FOR MATCHING
GRANT FUNDS FROM STATE OF FLORIDA,
DEPARTMENT OF AGRICULTURE AND
CONSUMER SERVICES DIVISION OF
FORESTRY FOR IN HOUSE TRAINING AND
GREEN HOUSE IMPROVEMENTS AND
EQUIPMENT IN THE AMOUNT OF $20,000;
PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECIIVE DATE.
WHEREAS, the City Commission of the City of Tamarac, Florida, desires to improve
the various areas within the City of Tamarac by adopting and promoting proper Urban and
Community Forestry Practices; and
WHEREAS, the City Commission of the City of Tamarac, Florida wishes to maintain
and expand open space and forest cover; and
WHEREAS, the City Commission of the City of Tamarac, Florida has recognized
the need to provide sound tree care and maintenance through staff training and green
house improvements and equipment; and
WHEREAS, it is a requirement of the program that this resolution be adopted and
become an official part of the application; and
WHEREAS, the City Commission of the City of Tamarac, Florida, is willing to

contribute local funds in the amount of twenty Thousand Dollars ($20,000) (50 percent of
the match) for financial assistance to the project; and
WHEREAS, the Director of Public Works recommends approval of this request; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to have an enhanced
tree care program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SEQIION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and is hereby made a specific part of this Resolution.
SECTION 2: The City Manager is hereby authorized to apply for matching
grant funding in the amount of $20,000 from the Department of Agriculture.
SECTION 3: Upon approval of the grant from the Department of Agriculture
a resolution accepting the grant will be proposed at that time.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

2. NO PROPOSAL SUBMITTED: It not submitting a proposal. respond by

3. PROPOSAL OPENING: Shall be public, on the date, location and the time
specified on the acknowlgement form. It is the proposers responsibility to assure that
his proposal la delivered at the proper time and place Of the proposal opening.
Proposals which for any reason are not so delivered, will not be considered. Offers
by telegram or telephone are not acceptable. A proposal may not be altered after
opening of the price proposals. NOTE* Proposal tabulations will be furnished upon
written request with an enclosed, self addressed, stamped envelope and payment

4. PRICES, TERMS AND PAYMENT: Firm prices shall be proposed and
include all services rendered to the purchaser.
(a) TAXES: The State of Florida does not pay Federal Excise and Sales taxes
on direct purchases of services. Sea tax exemption number on face of purchase
order or agreement form. This exemption does not apply to purchases of
services in the performance of contracts for the Improvement of stale -owned
real property as defined in Chapter 192, Florida Statutes-
(b) DISCOUNTS: Cash discount for prompt payment shall not be considered
in determining the lowest net cost for proposal evaluation purposes.
(c) MISTAKES: Proposers are expected to examine the conditions, scope of
work, proposal prices, extensions, and all instructions pertaining to the services
involved. Failure to do so will be at the proposer's risk,
(d) INVOICING AND PAYMENT: The contractor shall be paid upon
submission of property certified invoices to the purchaser at the prices stipulated
on the contract at the time the order is placed, after delivery and acceptance of
goods, less deductions if any, as provided. Invoices shall contain the contract
number, purchase order number and the contractors' Federal Employer loentifi-
cation Number. An original and three (3) copies of the invoice shall be submitted.
The final payment shall not be mace until after the contract is complete unless
Ina State has agreed otherwise. Invoices for fees or Other compensation for
services or expenses submitted for contractual services shall be suomnted in
detail sufficient for a proper preauda and postaudn thereof and invoices for any
travel expanses shell be submmed in accordance with the rates at or below those
specified in Sections 112-061 and 287,058. F.S. Interest Penalties Payment
shall be made in accordance with Section 215.422. F.S., which states the
contractors' rights and the State agency's responsibilities concerning interest
penalties and time limits for payment of invoices. VENDOR OMBUDSMAN:
Vendors providing goods and services to an agency should be aware of the
following time frames. Upon receipt, an agency has five (5) working days to
Inspect and approve the goods and services, unless the bid specifications,
purchase order or contract specifies otherwise. An agency has 20 days to deliver
a request for payment (voucher) to the Department of Banking and Finance.
The 20 days are measured from the latter of the date the invoice is received
or the goods or services are received, inspected and approved. If a payment
is not available within 40 days, a separate interest penalty of .03333 percent
per day will be due and payable, in addition to the invoice amount, to the vendor,
The Interest penalty provision applies after a 35 day time period to health care
providers, as defined by rule. Interest penalties of leas than one (1) dollar will
not be enforced union the vendor requests payment. Invoices which have to
be returned to a vendor because of vendor preparation errors will result in a
delay in the payment. The invoice payment requirements do not start until a
properly completed invoice is provided to the agency. A Vendor Ombudsman
has been established within the Department of Banking and Finance. The duties
of this individual include acting as an advocate for vendors who may be
experiencing problems in obtaining timely payment(s) from a state agency. The
Vendor Ombudsman may be contacted &t (904) 488.2924 or by Ceiling the State
Comptroller's Hotline, 1-800-048-3792, The Division of Purchasing shall review
the conditions and Circumstances surrounding non-payment and unless there
is a bonafide dispute, the Division may in writing authorize the contract supplier
to reject and return purchase orders from said agency until such time as the
agency complies with the provisions of Section 215.422. F.S.
(e) ANNUAL APPROPRIATIONS: The State of Florida's performance
and obligation to pay under this contract Is contingent upon an annual
appropriation by the Legislature.
5. CONFLICT OF INTEREST: The award hereunder is subject to the provisions
of Chapter 112. Florida Statutes. Proposers must disclose with their proposal the
name of any officer, director, or agent who is also an employee of the State of Florida,
or any o1 its agencies. Further. all proposers must disclose line name of any State
employee who owns, directly of indirectly, an interest of five (5%) or more in the

Project Title: Tamarac Demonstration Project
Proposer Name: City of Tamarac
Since Tamarac's incorporation in 1963, much of the wetlands, pastures and
fields have been turned into developed residential and commercial areas and land that
has undergone development. In 1991 Tamarac established an Urban Forestry
Committee consisting of staff and residents to help protect and maintain what urban
forest was left and to expand open space and forest cover.
Since 1991 the City has cultivated an understanding and appreciation of the
social, economic, environmental and aesthetic value of "the forest where we live." The
Committee was instrumental in the City's award of Tree City USA designation and
Arbor Day activities. The City of Tamarac has received grant awards from the Florida
Highway Beautiful Program, the Broward County Tree Trust Fund and private sponsors
as well as two grants from the Florida Department of Agriculture, the Urban and
Community Forest Program.
The two grants received from the Urban and Community Forestry Program
included a Tree Inventory and a Master Landscape Plan. The Tree Inventory is
complete and the Master Landscape Plan is in process. This demonstration project will
build on the foundation laid by the previous two grants.
One of the City's principle challenges is achieving a balance between
environmental and resource conservation, protection of natural and other pervious
areas, and new growth and development.
Based on the Master Landscape Plan, two model medians will be implemented.
Each demonstration project will be an important component to the overall forestry
program in Tamarac, as it will:
Establish demonstration projects to illustrate the benefits of forest cover and
trees.

Improve the citizens understanding of the benefits of planting and preserving
urban trees.
The purpose of the demonstration medians is to show the residents the proper
trees to plant in a specific area and to replace forest cover which was lost to urban
sprawl.
The two model medians are in a single family neighborhood and a multi -family
neighborhood. Lagos de Camp model median will include 30 trees and sod. The trees
recommended in the master landscape plan are: ten mahogany (12' tall), ten live oak
(12' tall), and ten pink tabebuia (8 - 10' tall). All trees will be no less than 4" in caliber.
These trees will be watered by the landscape maintenance staff. The thirty two (32)
trees recommenced for the Greenbriar median include six (6) queen palms (16' tall),
ten (10) live oak (12' tall), six (6) pink tabebuia (8-10' tall), and ten (10) mahogany (12'
tall). All trees will be no less than 4" in caliber. Sod will also be installed. An automatic
irregiation system, which will pump water from the nearby canal, will be installed.
The City of Tamarac enjoys good newspaper coverage by both the Sun -Sentinel,
the daily Broward County newspaper and the Forum, a weekly newspaper, which
covers both Tamarac and North Lauderdale. Both papers cover the action of the City
Commission, as well as features on neighborhood activities. Also published every other
month is the Tam -A -Gram which is distributed to each resident. Articles are also sent
to organizations such as the League of Cities.
The City desires to promote the planting and protection of trees to improve the
livability of our urban environment. The City understands the need to maintain our
forest cover and will provide proper tree care in perpetuity.
The City Commission of the City of Tamarac realizes that the ecosystems that
support our way of life are fragile. Many native plants and animals that are gone can
never be replaced. Therefore, it is necessary to restore and revitalize our
environmental lands. It is the desire of the City Commission to bring about positive
changes that will help create an environmentally healthy community.
