R-95-1.-�5 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO RELEASE A PORTION OF A CASH PERFORMANCE BOND IN THE AMOUNT OF $15,140.00 POSTED FOR PUBLIC IMPROVEMENTS AT UNIVERSITY PROFESSIONAL CENTER; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Mrs. Mirtha Camacho, as Principal, has filed with the City a cash bond in the amount of $15,140.00 to guarantee public improvements at the University Professional Center; and WHEREAS, it is the recommendation of the Public Works Director and the City Engineer that a portion of the Performance Bond be released, with a portion being retained as a one-year Warranty Bond, pursuant to the requirements of City Code Section 10-156; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to release a portion of this Cash Performance Bond in the amount of $15,140.00 posted for Public Improvements, with $4,327.75 retained for one year as a Warranty Bond. The facilities have been inspected and found acceptable by the Florida Department of Transportation (FDOT), and the Public Works and Utilities Departments. NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That a portion of a Cash Performance Bond posted by Mrs. Mirtha Camacho, as Principal, in the amount of $15,140.00 for public improvements at University Professional Center is HEREBY RELEASED with $4,327.74 retained for one year as a Warranty Bond. 1 1 1 Temp. Reso. #7061 SECTION 2: That the appropriate City Officials are hereby authorized to execute this Resolution to release a portion of a Cash Performance Bond in the amount of $15,140.00 posted for public improvements with $4,327.75 retained for one year as a Warranty Bond. SECTION a: All Resolutions or parts of Resolution in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portion or applications of this Resolution. SECTION 5: This resolution shall become effective immediately upon adoption. PASSED, ADOPTED AND APPROVED this day of 11995. ATTEST: CAROL A.
