CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-95- / 3r
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA AUTHORIZING THE PURCHASE
OF A FORD 555D TRACTOR/BACKHOE WITH OPTION
#4404-HYDRAULICALLY EXTENDING BACKHOE DIPPER
AND OPTION #6001-WARNING LIGHT FROM FORD NEW
HOLLAND, UTILIZING STATE OF FLORIDA CONTRACT
#760-001-95-1, AT A TOTAL COST OF $30,226.00, FUNDED
UNDER UTILITIES WASTEWATER ACCOUNT; PROVIDING
FOR CONFLICTS, PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, tractor/backhoe #437,which was purchased in 1983 at a cost of
$27,986.00 is non -operational and in need of approximately $25,000.00 in repairs; and
WHEREAS, the wastewater division's operation has been expanded to include
excavations and repairs, therefore necessitating a full time backhoe; and
WHEREAS, the State of Florida awarded contract #760-001-95-1 for the purchase
of Ford 555D tractor/backhoe to Ford New Holland for a total cost of $30,225.00; and
WHEREAS, City Code §6-155 allows the waiver of formal contract procedures for
all supplies and material and equipment which are the subject of contracts with the State
of Florida; and
WHEREAS, The Utilities Director and the Purchasing Officer recommend the
purchase of a Ford 555D Tractor/Backhoe from Ford New Holland; and
WHEREAS, The City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to purchase a Ford
555D Backhoe/Tractor from Ford New Holland.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution.
Section 2: That the purchase of a Ford 555D at a total cost of $30,225.00 IS
HEREBY APPROVED to be purchased from Ford New Holland.

Section 3: That funding for the backhoe/tractors budgeted under the Utilities
Department "Machinery and Equipment" in the amount of $30,225.00.
Sic ign 4: All Resolutions or parts of Resolutions in conflict herewith are hereby
repealed t the extent of such conflict.
ec ion • If any clause, section, other part or application of this Resolution is held
by any court of competent jurisdiction to be unconstitutional or invalid, in part or application,
it shall not affect the validity of the remaining portions or applications of this Resolution.
Section 6: This Resolution shall become effective immediately upon its passage
and adoption.
