R 95- I59 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE REJECTION OF ALL BID PROPOSALS SUBMITTED IN RESPONSE TO BID NUMBER 95-08 ENTITLED "NORTH WEST 67TH STREET ROADWAYS AND UTILITIES" IN THE BEST INTEREST OF THE CITY OF TAMARAC AND THE PUBLIC IT SERVES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE WHEREAS, Bid Number 95-08 was advertised in the Sun Sentinel on June 11 and 18, 1995; and WHEREAS, Bids were opened at 2:00 P.M. on Monday, June 26, 1995; and WHEREAS, the bid proposals received exceed the funds available for this project; and WHEREAS, it is the recommendation of the Purchasing Officer in agreement with the City Manager, the Public Works Director, the Utilities Director and the Community Development Director that Bid Number 95-08 be rejected in the best interest of the City of Tamarac and the public it serves; and WHEREAS, Section §6-149(4) of the City Code States that "if a bid or a part of a bid is rejected, the Council may authorize negotiation of a price with the lowest bidder at no substantial modification of the bid specifications"; and WHEREAS, it is the recommendation of the Purchasing Officer, the City Manager, the Public Works Director, the Utilities Director and the Community Development Director that the City Commission authorize negotiations with the lowest bidder, Weekly Asphalt Paving Incorporated; and WHEREAS, should the City find that acceptable terms cannot be negotiated that the project be rebid; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to reject all bid proposals submitted in response to Bid Number 95-08 entitled "North West 67th Street Roadways and Utilities." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Temp Reso 7137 Revised 7/12/95 Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: The bid proposals received exceed the funds available for this project. Section 3: It is in the best interest of the City of Tamarac and the public it serves to reject all bids submitted in response to Bid #95-08 entitled "North West 67th Street Roadways and Utilities." Section 4: The rejection of Bid Number 95-08 IS HEREBY APPROVED. Section : Authorization to negotiate with the lowest bidder, Weekly Asphalt Paving Incorporated IS HEREBY APPROVED. Section 6: Authorization to rebid the project should the City find that acceptable terms cannot be negotiated IS HEREBY APPROVED. Section 7: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 8: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
