R-95- /; % A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATION OF LAW ENFORCEMENT TRUST FUND MONIES IN THE AMOUNT OF $5,000 FROM RESOURCES AVAILABLE ACCOUNT #001- 389-105 TO FUND EDUCATIONAL TRAINING OF LAW ENFORCEMENT PERSONNEL AND CITY EMPLOYEES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY: AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, law enforcement education funds are levied by the Clerk of the Court and earmarked for law enforcement use pursuant to Florida Statutes 943.25; and WHEREAS, in 1989 the Tamarac Law Enforcement Trust Fund was established for law enforcement personnel education; and WHEREAS, the Tamarac Law Enforcement Trust Fund monies in the amount of $14,380.14 were placed in the police reserve account and must be appropriated to a line item before expenditure; and WHEREAS, the City of Tamarac has scheduled a joint educational opportunity for Broward Sheriffs Office employees and City of Tamarac employees; and WHEREAS, the Assistant City Manager, Budget Officer and Tamarac BSO District VI Commander recommend approval to appropriate the law enforcement trust fund monies from Police Reserve account to a line item account; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interests of the citizens and residents of the City of Tamarac to transfer these funds. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS' clauses are hereby ratified and confirmed LJ 1 1 2 Temp. Reso. #7143 as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the appropriation of $5,000 to Police Expense Account #001-220- 521-543 from Resources Available Account #001-389-105 is hereby approved in order to fund educational training and reduce fund balance designated for Police Education #001-271-453 by said amount. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
