R-95--tV A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE THE TRANSFER OF $505,535.70 FROM TRAFFICWAYS IMPROVEMENT FUND, ACCOUNT NO.144-888-541-99C TO "EAST -WEST CONNECTOR ROAD (N.W. 67th STREET)," ACCOUNT NO. 144-888-541-6FB AND TRANSFER $397,500.80 FROM THE UTILITIES WATER AND SEWER DEVELOPER IMPACT FEE, ACCOUNT NO. 432-872-588- 99C TO "N.W. 67th STREET WATER AND SEWER IMPROVEMENTS," ACCOUNT NO. 432-888-536-67M TO PROVIDE FUNDING FOR THE AWARD OF BID NO.95-12 ENTITLED "NORTHWEST 67th STREET ROADWAY AND UTILITIES" AND RETAINING HAZEN & SAWYER, P.C. TO PROVIDE PROJECT MANAGEMENT SERVICES; APPROVING THE AWARD OF BID NO.95-12 TO HARDRIVES, INC. OF DELRAY BEACH; APPROVING THE RETAINAGE OF HAZEN & SAWYER, P.C. TO PROVIDE PROJECT MANAGEMENT SERVICES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Tamarac publicly advertised Bid No. 95-12 for Northwest 67th Street Roadway and Utilities in the Sun -Sentinel on July 14 and 19, 1995; and WHEREAS, on July 24, 1995 the following six (6) bids were opened: 1. Hardrives, Inc. Bid Offer $836,036.50 2. Weekley Asphalt Paving, Inc. Bid Offer $838,264.53 3. Smith & Company, Inc. Bid Offer $851,830.10 4. Telcon, Inc. Bid Offer $863,870.20 5. W. Jackson & Sons Construction Co. Bid Offer $867,869.10 6. D.C. Hiatt Trucking, Inc. Bid Offer $100,432.55; and 1 1 1 Temp. Reso. #7150 WHEREAS, Hardrives, Inc. submitted the lowest bid proposal at $836,036.50; and WHEREAS, Hazen & Sawyer, P.C. has submitted Addendum No.95-09 to the Engineering Agreement to provide Project Management Services for an amount not to exceed $67,000.00; and WHEREAS, funds in the amount of $505,535.70 needs to be transferred from the "Trafficways Improvement Fund," Account No. 144-888-541-99C to "East-West Connector Road (N.W. 67th Street)," Account No. 144-888-541-6FB and funds in the amount of $397,500.80 need to be transferred from The Utilities Water and Sewer Developer Impact Fee, Account No.432-872-588-99C to "N.W. 67th Street Water and Sewer Improvements," Account No. 432-888-536-67M to fully fund the award of Bid No. 95-12 and retain Hazen & Sawyer, P.C. to provide Project Management Services for the project; and WHEREAS, it is the recommendation of the Public Works Director, the Utilities Director and the City Engineer that the project be fully funded and that Bid No.95-12 be awarded to the lowest responsive and responsible bidder, Hardrives, Inc. Of Delray Beach, Florida and Hazen & Sawyer, P.C. be retained to provide Project Management Services, and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve the award of Bid No. 95-12, " Northwest 67th Street Water and Sewer Improvements," to Hardrives, Inc. for $836,036.50, and retain Hazen & Sawyer, P.C. to provide Project Management Services for an amount not to exceed $67,000.00. 2 1 Temp. Reso. #7150 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS' clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: That the appropriate City Officials are hereby authorized to approve a budget transfer of $505,535.70 from the "Trafficways Improvement Fund," Account No. 144-888-541-99C to "East-West Connector Road (N.W. 67th Street)," Account No. 144- 888-541-6FB and funds in the amount of $397,500.80 from the Utilities Water and Sewer Developer Impact Fee, Account No. 432-872-588-99C to "N.W. 67th Street Water and Sewer Improvements," Account No. 432-888-536-67M. SECTION 3: That the award of Bid No. 95-12 to Hardrives, Inc. of Delray Beach, Florida is HEREBY APPROVED. SECTION 4: That Addendum No.95-09 to the Engineering Agreement with Hazen & Sawyer, P.C. (attached as Exhibit 1) is HEREBY APPROVED. SECTION 5: That the City Manager or his designee be authorized to make changes, issue change orders not to exceed $10,000 per Section 6-156 (b) of the City Code, and close the bid award including but not limited to making final payment and releasing bonds when the work has been successfully completed within the terms and conditions of the contract and within the bid price. SECTION 7: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portion or applications of this Resolution. 9 Temp. It is understood that said services will be provided in accordance with our City Consulting Engineering Services Agreement with the City, as authorized by the City on February 23, 1994. Except as mar be explicitly revised or amended below for application specifically to this Addendum, all provisions of said Agreement shall apply. In accordance with Section I of the Agreement, ENGINEER has assigned Job Number 8618 to the task(s) included under this Addendum. Colombia RVEN AND SAWYER ADDENDUM NO. 95-09 July 14, 1995 CITY OF TAMARAC NORTHWEST 671th STREET CONSTRUCTION TASK SCHEDULE Task Order General Description PREAMBLE This addendum provides design coordination services and resident engineering services for two construction projects (Lift Station 45 and Northwest 67th Street Construction) associated with the development of the North Half of Land Section 7. 1 DESIGN COORDINATION This task is for additional design services associated with Northwest 67th Street underground utilities including, but not limited to, the following: additional design coordination and meetings with developer and consultants, coordination and addition of provisions for future utilities, and associated revisions of the design due to fast tracking the project. 2 CONSTRUCTION OBSERVATION Note: Hazen and Sawyer, P.C., shall provide up to 576 hours (72 man -days) of observation time within the $35,000 not -to -exceed fee. 2.1 Observation of Contractor's construction progress on a day-to-day basis for conformance with the Contract Documents. 2.2 Maintain proper and accurate accounts with respect to the work performed by both contractors, and keep the City advised as to the status of work performed monthly. 2.3 Review and approve certificates for partial and final payments to contracts. 2.4 Arrange for testing of soil concrete and other construction materials and review of results. Testing will be paid for by the City. Time of Performance(') Compensation (2) 30 Days $ 9,000 150 Days $35,000 Page 2 of 5 Hwd.8618C001 HAZEN AND SAWYER -�l ADDENDUM NO. 95-09 July 14, 1995 Task Order General Description 2.5 Observe and evaluate field tests as required on equipment to determine acceptability and conformance with specifications and permits. 2.6 Coordinate between the Lift Station 45 contractor, the Northwest 67th Street Construction contractor and the developer (Butters) and his contractor and the roadway design consultant. 2.7 Prior to final payment to the Contractor, Hazen and Sawyer shall make a final review of the construction which shall include investigating and reporting and discrepancies from the Contract Documents and report them to the City. 2.8 Furnish copies of the resident inspector's daily reports to the City weekly. • 3 GENERAL SERVICES DURING CONSTRUCTION 3.1 Schedule and conduct a pre -construction conference. 3.2 Provide interpretation of plans and specifications. Request for interpretation of roadway plans from the roadway design consultant. 3.3 Attend all progress meetings called for by the City. Hazen and Sawyer shall keep the City informed of the progress of the work that does not, in Hazen and Sawyer's opinion, conform to the Contract Documents. 3.4 Receive and evaluate reports by laboratories in the inspection and testing of materials used in the construction. 3.5 Check and receive samples, schedules, shop drawings (Lift Station 45 and the Underground Utilities portion of the Northwest 67th Street Utilities) and other submissions for conformance with the by the Contract Documents. Page 3 of 5 Hwd.8618C001 Time of Performance(') Compensation(2) 150 Days $23,000 111.W NMI V � :,,W 0 ADDENDUM NO. 95-09 July 14, 1995 Task Time of Order General Description Performance(') Compensation(2) 3.6 Prepare any necessary change orders and assemble written guarantees required of the Contractors. 3.7 Meet periodically with the City, other consultants and contractors for consultation or conferences in regard to construction of the project. 3.8 Review the Contractor -prepared as -built drawings after completion of the construction of the Lift Station 45 contract and the underground utilities(water mains, force mains and gravity sanitary sewer system) portion of the Northwest 67th Street Construction contract. Record Drawings shall be prepared from the contractor as -built drawings. Two sets of blueline drawings, or set of vellum reproducible drawings and an AutoCADD disk of the Record Drawings shall be supplied to the City within sixty days after completion of construction. Roadway Record Drawings will be prepared by others. 3.9 Declare that the project has been built in accordance with the plans and specifications based upon available construction records.
