CITY OF TAMARAC
RESOLUTION NO. R-95-175
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO ENTER INTO AN AGREEMENT
WITH LUTHERAN MINISTRIES OF FL, INC.
ALLOWING THE CITY'S FIRE STATIONS TO
SERVE AS "SAFE PLACES"; ALLOWING FOR
TERMINATION; OUTLINING RESPONSIBILITIES;
AND PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFE TIVE DATE.
WHEREAS, the Lutheran Ministries of Florida, Inc. has developed a program of
Project Safe Place for children between the ages of 10-17 years of age,
WHEREAS, over 100 locations in Broward County have been designated as
Safe Places;
WHEREAS, Municipal Fire Stations are located strategically throughout the
County and offer a recognized resource for a!I people of all ages needing help;
WHEREAS, the Fire Chief recommends participation in the Safe Place program;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY

OF TAMARAC, FLORIDA:
S=ion 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
resolution.
Section 2: The City Commission hereby agrees to participate in the "Safe
Place" program.
Section 3: That the appropriate city officials be authorized to enter into this
agreement between the City of Tamarac and the Lutheran Ministries of FI., Inc., a copy
of said agreement being attached hereto as Exhibit 1.
Seglign 4: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
Section 5: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
Section This Resolution shall become effective immediately upon its
passage and adoption.

AGREEMENT
THIS IS AN AGREEMENT dated the
1995, between:

THE CITY OF TAMARAC, a municipal corporation
of the State of Florida, hereinafter referred
to as "CITY"
and
LUTHERAN MINISTRIES OF FLORIDA, INCORPORATED, A
non-profit corporation through its affiliate
LIPPMAN FAMILY CENTER, hereinafter referred to as
"LUTHERAN MINISTRIES".
WITNESSETH:

WHEREAS, the City of TAMARAC authorizes the CITY'S Fire Stations to serve
as "Safe Places" as part of the Program of Project Safe Place of the LUTHERAN
MINISTRIES OF FLORIDA, INCORPORATED in Broward County for children between
the ages of ten through seventeen years of age; and
WHEREAS, the City Fire Chief or his designee of the CRY'S Fire Department
shall coordinate and carry out that part of the Program incumbent upon the City to
perform in accordance with this Agreement between the LUTHERAN MINISTRIES and
the City of Tamarac;
NOW, THEREFORE, in consideration of the mutual promises,
agreements and covenants herein contained and other good and valuable

the City's Social Services Coordinator or BSO as appropriate.
D) LUTHERAN MINISTRIES agrees to hold harmless, indemnify and
defend the CITY, its officers, agents and employees, at no cost to
the CITY, in the event that a claim is made against the CITY
arising out of its participation in the Safe Place Program, including
but not limited to any claim for bodily injury, death or property
damage. In the event this contract results in litigation between
LUTHERAN MINISTRIES and CITY, the parties hereto agree that
this contract shall be construed according to the laws of the State
0 of Florida and that venue shall be set in Broward County.
E) LUTHERAN MINISTRIES agree to obtain, pay for and keep in
force continuously for the full term of this Agreement, general
comprehensive and all inclusive public liability insurance, in a form
and amount acceptable to the CITY's Risk Manager, with policy
limits of not less than one million dollars ($1,000,000) for any one
person, and one million dollars ($1,000,000) for any one accident,
with coverage which shall include property damage, bodily injury
and death. A valid Certificate of Insurance shall be provided to
CITY by LUTHERAN MINISTRIES no later than fifteen (15) days
before the date permission is given to first use the CITY'S Fire

5. Term.
This Agreement shall begin on October 1, 1995 ,
and shall end upon ten (10) days written notice by one party to the other.
Upon ten (10) days written notice, CITY shall have the right to cancel this
Agreement for cause, and to terminate the Agreement to allow CITY's fire
stations to serve as "Safe Places".
IN WITNESS OF THE FOREGOING, the parties have
made and executed this Agreement on the respective dates under each signature.
