A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO APPROVE THE
CLOSING OF THE CONTRACT WITH McKAY
CONTRACTING, INC. FOR THE WOODLANDS FORCE
MAIN IMPROVEMENTS AND AUTHORIZE THE FINAL
PAYMENT OF $11,792.17 SUBJECT TO THE RECEIPT OF
THE FINAL RELEASE OF LIENS AND AFFIDAVIT ON
BEHALF OF CONTRACTOR, PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City Commission awarded Bid No. 94-09 to McKay Contracting,
Inc. on June 22, 1994 for the Woodlands Force Main Improvements located in Banyan
Lane between Commercial Boulevard and Hazelwood Circle in the Woodlands (shown
in map form as "Exhibit 1"); and
WHEREAS, McKay Contracting, Inc. completed the Woodlands Force Main
Improvements Project which has been inspected and recommended for acceptance by
the Utilities Engineering Division; and

WHEREAS, McKay Contracting, Inc. has incurred liens on this project; and
WHEREAS, it is the recommendation of the Utilities Director that the contract for
the Woodlands Force Main Improvements between McKay Contracting, Inc. and the
City of Tamarac be approved for closing and the final payment be authorized subject to
the receipt of the final Release of Liens and Affidavit on Behalf of the Contractor; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be
in the best interest of the citizens and residents of the City of Tamarac to approve the
closing of the contract to McKay Contracting, Inc. for the Woodlands Force Main
Improvements and authorize the final payment of $11,792.17 subject to the receipt of
the final Release of Liens and Affidavit on Behalf of the Contractor.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
resolution.

SECTION 2: That the appropriate City Officials are hereby authorized to
approve the closing of the contract with McKay Contracting, Inc. and approve the final
payment of $11,792.17 subject to the receipt of the final Release of Liens and Affidavit
on Behalf of the Contractor.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining portions or
applications of this Resolution.
