R-95--/-�—/ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE TRANSMITTAL OF A PROPOSED AMENDMENT TO THE BROWARD COUNTY TRAFFICWAYS PLAN, PROVIDING THAT A PORTION OF SOUTHGATE BOULEVARD AND A PORTION OF MCNAB ROAD ABUTTING THE SAWGRASS EXPRESSWAYAS DESCRIBED AS EXHIBIT "A" OF THIS RESOLUTION BE REMOVED FROM THE TRAFFICWAYS PLAN; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City has previously adopted the Broward County Trafficways Plan ("The Plan") as a part of the traffic circulation element of the City's Comprehensive Plan, in accordance with Section 163.3177(6)(b) Florida Statutes; and WHEREAS, the Broward County Planning Council has established a procedure whereby an amendment to the Broward County Trafficways Plan may be considered; and WHEREAS, the Plan currently shows Southgate Boulevard and McNab Road extended to the Sawgrass Expressway; and WHEREAS, the City Commission approved Resolutions R-93-139 and R-93-140 vacating the rights -of -way for the segments of Southgate Boulevard and McNab Road; and WHEREAS, the City desires to remove a portion of Southgate Boulevard and a portion of McNab Road abutting the Sawgrass Expressway as described as Exhibit "A" 1 Temp. Reso. #7189 2 Rev. No. 1 - Sept. 5, 1995 from the Broward County Trafficways Plan; and WHEREAS, the Director of Community Development recommends approval of the amendment s to the Broward County Trafficways Plan; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to request the Broward County Planning Council to adopt the amendment to the Trafficways Plan to remove a portion of Southgate Boulevard and a portion of McNab Road abutting the Sawgrass Expressway as described as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION t The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2= The appropriate City Officials are authorized to transmit to the Broward Planning Council for review the proposed amendment to the Broward County Trafficways Plan providing that a portion of Southgate Boulevard and McNab Road abutting the Sawgrass Expressway as described as Exhibit "A" of this resolution, be removed from the Trafficways Plan. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. 1 1 Temp. Reso. #7189 3 Rev. No. 1 - Sept. 6, 1995 SECTION_4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
