CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-95- ;�Q�
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA INCREASING THE MONTHLY RATE
PAID TO SOUTHERN SANITATION FOR RESIDENTIAL
MULTI -FAMILY SOLID WASTE SERVICE $.17 PER CUBIC
YARD EFFECTIVE OCTOBER 1, 1995; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac has a contract with Southern Sanitation for
collection and disposal of solid waste from residential multi -family residences within the
City of Tamarac; and
WHEREAS, Broward County has increased the disposal fee from $75.87 to $77.32
per ton; and
WHEREAS, Broward County mandated that this fee increase would be effective
October 1 st of each year; and
WHEREAS, Article 8.1 of the agreement between the City of Tamarac and Southern
Sanitation for multi -family solid waste collection provides for certain adjustments of the
monthy rates upon notification by Southern Sanitation that Broward County's disposal fees
have increased, a copy of said notice by Southern Sanitation dated July 6, 1995 attached
as Exhibit 1 "; and
WHEREAS, based on the Broward County disposal fee increase, Southern
Sanitation has requested a monthly rate increase of $.17 per cubic yard for residential
multi -family solid waste service, effective October 1, 1995; and

WHEREAS, the City Manager and Assistant City Manager recommend approval;
WHEREAS, the City Commission deems it to be in the best interests of the citizens
and residents of the City of Tamarac to approve the multi -family rate increase of $.17 cubic
per yard as a result of Broward County increasing the disposal fee from $75.87 to $77.32
per ton.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
S TIC: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECT, _ ION 2: That the monthly rate for providing residential multi -family solid waste
service will be increased by $.17 per cubic yard effective October 1, 1995.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
E ION : This Resolution shall become effective immediately upon its passage
and adoption.

Dear Mr. Noe:
Based on Article 8 of our contract, the monthly rate for providing multi -family solid waste service
will be increased by $.17 per yard effective October 1, 1995. The adjustment was computed as
follows:
Broward County's disposal fees, based on the Interl on Hula in aurAgreement, will increase co tract providesrfor
$75.87 to $77.32 per ton. The disposal pass through f
ten cents ($.10) per cubic yard plus 15% franchise fee for each one dollar ($1.00) change
in the per ton disposal rate ($1.45 x.10/85).
