R 95- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE PURCHASE OF SAFETY SHOES FROM IRON AGE CORPORATION IN ACCORDANCE WITH THE UNITED STATES GENERAL SERVICES ADMINISTRATION (GSA) CONTRACT GS-07F- 8254B, WITH A TOTAL COST NOT TO EXCEED $17,500, APPROVING FUNDING FROM VARIOUS ACCOUNTS UNDER OBJECT CODE 475 ENTITLED PROTECTIVE CLOTHING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE WHEREAS, The Federation of Public Employees Contract with the City requires that the City provide safety shoes for all designated employees in the Bargaining Unit; and WHEREAS, Iron Age Corporation has offered to extend prices set forth in the United States General Services Administration (GSA) Contract GS-07F-8254B to the City of Tamarac; and WHEREAS, City Code §6-155 allows the Purchasing Officer to procure, without following formal contract procedure, all supplies materials and equipment which are the subject of contracts with the State as set forth in F. S. section 287.051, or with the United States Government; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the purchase of safety shoes from Iron Age Corporation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: The purchase of safety shoes IS HEREBY APPROVED to be purchased from Iron Age Corporation in accordance with the terms and conditions of the United States General Services Administration Contract GS-O7F-8254B. Section 3: Funding for this purchase is available under various accounts under object code 475, entitled Protective Clothing, with a total cost not to exceed $17,500, Section 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp. Reso. 7229 Revised 10/04/95 Section 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Section 6: This Resolution shall become effective immediately upon its passage and adoption.
