R 95- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE PURCHASE OF TWO WAY HAND HELD MOBILE RADIOS FROM EXPRESS RADIO UTILIZING THE DADE COUNTY PUBLIC SCHOOL BOARD BID NUMBER 230-RR11; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE WHEREAS, The City of Tamarac is replacing approximately 35% of its two way hand held mobile radios purchased from 1987-1989; and WHEREAS, The Dade County Public School Board awarded bid number 2309- RR11 to Express Radio; and WHEREAS, Express Radio has offered to extend the same prices and conditions set forth in the Dade County Public School Board Bid to the City of Tamarac; and WHEREAS, City Code §6-154 allows the Purchasing Officer the authority to join with other units of government in cooperative purchasing when the best interest of the City would be served; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the purchase of two way mobile radios from Express Radio. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: The purchase of two way mobile radios IS HEREBY APPROVED to be purchased from Express Radio in accordance with the terms and conditions of the Dade County Public School Board Bid #230-RR11. Section 3: Funding for this purchase is available under account 502-702-592-643 entitled "Machinery and Equipment" for $30,000. Section 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp. Reso. 7243 Section 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
