RESOLUTION NO. R-95--A-39
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA;
APPROVING A MINOR DELEGATION
REQUEST TO AMEND THE PLAT
RESTRICTIONS TO INCREASE THE TOTAL
NUMBER OF RESIDENTIAL UNITS AND
REDUCE COMMERCIAL SQUARE FOOTAGE
FROM THE LAND SECTION 8 PLAT,
ACCORDING TO THE PLAT THEREOF, AS
RECORDED IN PLAT BOOK 154, AT PAGE 48,
OF THE PUBLIC RECORDS OF BROWARD
COUNTY, FLORIDA, LOCATED ON THE
NORTH SIDE OF COMMERCIAL BOULEVARD
BETWEEN NOB HILL ROAD AND NW 94
AVENUE; PETITION NO. 8-P-95; PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE,
WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of
Tamarac, Florida, a public meeting has been advertised in accordance with applicable code
sections of the date, time and place of the meeting regarding delegation requests; and
WHEREAS, the City Commission has examined the application and staff
recommendation dated October 18, 1995; and
WHEREAS, the City Commission has determined that the application is in compliance
with all elements of the Comprehensive Plan for the development that is the subject of the
application; and
WHEREAS, at the time the plat was recorded, Broward County did not have the benefit
of a conceptual site plan for the proper determination of residential units and commercial
square footage; and

WHEREAS, the property owner desires to amend the plat restrictions to increase the
total number of residential units and reduce commercial square footage from the recorded plat;
and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the
best interests of the citizens and residents of the City of Tamarac to approve this delegation
request;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby approves the delegation request
to amend the Plat restrictions to increase the total number of residential units and reduce
commercial square footage on the Land Section 8 Plat according to the Plat thereof as
recorded in Plat Book 154 at Page 48 of the Public Records of Broward County, Florida. The
plat notation being amended reads as follows:
This Plat is restricted to 290 townhomes and 217 single-family residences in Parcels A,
B and C.
SECTION_;, All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4_ If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5: This Resolution shall become effective immediately upon its
