R-95- ;(7-7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; AUTHORIZING LUTZ PETROLEUM EQUIPMENT INSTALLATIONS, INC. TO INSTALL A FIVE HUNDRED GALLON CONVAULT DIESEL TANK AND REMOVE THE EXISTING TANK AT FIRE STATION #2 UTILIZING THE PALM BEACH COUNTY SCHOOL BOARD BID AT A TOTAL COST OF $26,775.00; FUNDING IN THE AMOUNT OF $26,775 IS BUDGETED UNDER ACCOUNT #001-888-539-61 D ENTITLED, "DIESEL TANK CONVERSION"; PROVIDING FOR CONFLICTS, PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. Whereas, the Department of Natural Resource Protection has concerns with the current diesel dispensing system meeting appropriate standards; and Whereas, Lutz Petroleum Equipment Installations has offered to extend the terms and conditions of the Palm Beach County School Board Bid to the City of Tamarac (attached as Exhibit "A"); and Whereas, the total cost will be $26,775.00 and is funded under Account no. 001- 888-539-61 D entitled, "Diesel Tank Conversion," in the amount of $26,775; and Whereas, it is the recommendation of the Fire Chief and the Purchasing Officer that this work be awarded to Lutz Petroleum Equipment Installations; and 1 Temp Reso #7236 Whereas, City Code §6-154 allows the Purchasing Officer to join with other units of Government in cooperative purchasing when the best interest of the City will be served; and Whereas, the City Commission of the City of Tamarac, deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize Lutz Petroleum Equipment Installation to remove the existing non -compliant diesel tank and install a five hundred gallon vaulted diesel tank at Fire Station #2. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SEQI 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: That Lutz Petroleum Equipment Installation is authorized to install a five hundred gallon vaulted diesel tank and to remove the existing diesel tank at a cost of $26,775.00 under the terms and conditions of the Palm Beach County School Board Bid (attached as Exhibit "B") work. SECTION 3: Lutz Petroleum will secure all necessary permits prior to beginning SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or Temp Reso #7236 0 1 1 application, it shall not effect the validity of the remaining portions or applications of this Resolution. P.03 OCT--05-1995 11:38 9 7 ] Exhibit u$u P.02 CONTRACT BETWEEN THE SCHOOL BOARD OF PALM BEACH COUNTY, FLORIDA AND LUTZ PETROLEUM EQUIPMENT This contract is made by and between THE SCHOOL BOARD OF PALM BEACH COUNTY, FLORIDA, (hereinafter referred to as the Board or School Board) and LUTZ PETROLEUM EQUIPMENT, (hereinafter referred to as the Contractor to provide Petroleum Related Services, SECTION I - Term of Contract This contract shall be for the period beginning April S. 1995 through April 5, 1996. The contract may be renewed for three additional one-year periods at the annual anniversary date. The contract will not extend beyond the fourth year. SECTION 11 - Services The Contractor shall provide Petroleum Related Services per specifications in RFP 95C-015W and the proposal submitted by the Contractor. All addenda issued to RFP 95C-015W, if any, are also made a part of this contract. SECTION III - Cost of Services The Contractor shall be paid for services as listed in the RFP for Petroleum Related Services for the School District of Palm Beach County. SECTION IV - Terms and Conditions The Contractor shall have the option to terminate the contract upon written notice to the autho- rized representative of the School Board. Such notice must be received at least 90 days prior to the effective date of termination. The School Board shall have the option to terminate the contract upon written notice to the authorized representative of the Contractor. Such notice must be received at least 30 days prior to the effective date of termination and the Contractor shall only be entitled to compensation up to the date of termination. Included in this Agreement are the terms and conditions as described in the Request for Proposal, RFP 95C=015W, which by reference herein is made a part thereof. SECTION V - Indemnification For the purposes of general liability as opposed to professional liability which is addressed in the second paragraph of this Article, the Contractor agrees to protect, defend, reimburse, indemnify and hold the School Board, its agents, employees and elected officials, and each of them free and harmless at all times from and against any and all suites, actions, legal or administrative proceedings, claims, demands, damages, liabilities, interest, attorney's fees, costs and expenses of whatever kind or nature whether arising during or after completion of the work hereunder and in any manner directly or indirectly caused; occasioned or contributed to In whole or in part, by reason of any act, omission, fault or negligence whether active or passive of the Contractor or anyone acting under its direction or control, or on its, behalf in connection with or incident to the performance of this contract. The Contractors aforesaid indemnity and hold harmless obligations, or portions of applications thereof, shall apply to the fullest extent permitted by law but in no event shall they apply to liability caused by the sole negligence or willful misconduct of the School Board, its elected officials, employees and authorized agents. SECTION VI - Insurance Insurance will be required as stated in RFP 95C-015W. The School Board of Palm Beach County shall be named as additional insured. SECTION VII - Amendment This contract shall only be amended or modified in writing executed by both parties. An elementary school located in the city of West Palm Beach has a 1,000 gallon under- ground, We steel, single -walled storage tank that supplied No. 2 diesel fuel to a boller. Product line (50 feet) and vent pipe (20 feet) are steel. Soils surrounding the tank were found to contain petroleum products at 75 ppm as read by an Organic Vapor Analyzer. Tank has been pumped and currently contains less than one inch of product. The tank is under asphalt with 1,000 yards clearance In all directions. No underground or overhead utilities are known to be in the area. One ton of concrete is involved in ballast and bed. Tank' and line are to be tested, removed, and replaced with a double -walled fiberglass tank and secondarily contained piping. School will be in session during all tasks.
