A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO REIMBURSE N&S BUTTERS FOR
PROFESSIONAL AND CONSTRUCTION SERVICES IN THE
DEVELOPMENT OF N.W. 67TH STREET PROJECT IN THE
AMOUNT OF $47,800; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac, Florida adopted Resolution
R-94-245 which authorized the City to apply for financial assistance from the State to
design and construct N.W. 67th Street; and
WHEREAS, the City Commission of the City of Tamarac Florida has determined
N.W. 67th Street to be an important transportation project; and
WHEREAS, N.W. 67th Street will provide access from Nob Hill Road to the ITW
Mima, ITW Loveshaw, and Arch Aluminum and Glass projects; and
WHEREAS, on October 11, 1995 the City of Tamarac received $215,949.60 from
the State of Florida Economic Development Transportation Fund for the N.W. 67th Street
Project; and
WHEREAS, N&S Butters Company provided the City with professional and
construction services for the N.W. 67th Street Project; and
WHEREAS, N&S Butters Company provided environmental permitting, wetland
mitigation, drainage permitting, drainage engineering, clearing and grubbing; and the

construction of the pad for the lift station required by the Utilities Department relating to the
N.W. 67th Project; and
WHEREAS, N&S Butters Company requested reimbursement by the City for
professional and construction services performed in the development of the N.W. 67th
Street Project in the amount of $47,800; and
WHEREAS, the work and expenditures relating to the N.W. 67th Street project have
been approved by the Utilities Director, the Public Works Director, the Community
Development Director and City Manager; and
WHEREAS, the Director of Community Development and City Manager recommend
approval of this request; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to authorize the
appropriate City officials to reimburse N&S Butters for the professional and construction
services in the development of the N.W. 67th Street Project in the amount of $47,800.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SFrTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the appropriate City officials are hereby authorized to reimburse
N&S Butters Company for the professional and construction services in the development
of the N.W. 67th Street Project in the amount of $47,800.

SECTION 3: That the Finance Director is hereby authorized to fund the
reimbursement from Account #144-888-5416F-B East West Connector Road - Northwest
67th Street account.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
,SECTION 6: This Resolution shall become effective immediately upon its passage
and adoption.
