R-95-VVI A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ELECTING TO USE THE UNIFORM METHOD OF COLLECTING NON -AD VALOREM SPECIAL ASSESSMENTS LEVIED WITHIN ALL OF THE INCORPORATED AREA OF THE CITY OF TAMARAC; STATING A NEED FOR SUCH LEVY; PROVIDING FOR THE MAILING OF THIS RESOLUTION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac, Florida is considering the imposition of special assessments up to and including the maximum amount permitted by law for the funding of fire/rescue services and facilities; and WHEREAS, the City of Tamarac is considering using the uniform method for collecting non -ad valorem special assessments for the cost of providing fire/rescue services and facilities to property within all of the incorporated area of the City as authorized by section 197.3632, Florida Statutes, as amended, because this method will allow such special assessments to be collected annually commencing in November 1996, in the same manner as provided for ad valorem taxes; and WHEREAS, the City of Tamarac held a duly advertised public hearing prior to the adoption of this Resolution, proof of publication of such hearing being attached hereto as Exhibit A; and 1 Temp. Reso. #7278 Revision #1 11/30/95 Revision #2 12/5/95 WHEREAS, it is the recommendation of the City Manager that the assessment method be used as herein described and delineated by the law firm of Nabors, Giblin and Nickerson, P.A.; and WHEREAS, this Resolution does not obligate the City of Tamarac to use the method or impose a special assessment; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to authorize the uniform method of collecting non -ad valorem special assessments levied within all of the incorporated area of the City of Tamarac for the funding of fire/rescue services and facilities. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and is hereby made a specific part of this Resolution. SECTION 2: For the purpose of section 197.3632, Florida Statutes, the legal description of the boundaries of the real property subject to the contemplated special assessments for the funding of fire/rescue services and facilities shall be all of the incorporated area of the City of Tamarac. Reso. #7278 Revision #1 11/30/95 Revision #2 12/5/95 SECTION 3 Commencing with the Fiscal Year beginning on October 1, 1996 and with the tax statement mailed for such Fiscal Year, the City of Tamarac intends to use the uniform method of collecting non -ad valorem assessments authorized in section 197.3632, Florida Statutes, as amended, for collecting non -ad valorem assessments for the cost of providing fire/rescue services and facilities. Such non -ad valorem assessments shall be levied within all of the incorporated area of the City of Tamarac. SECTION 4: The City of Tamarac hereby determines that the levy of the assessments is needed to fund the cost of fire/rescue services and facilities within all of the incorporated area of the City of Tamarac. SECTION 5: Upon adoption, the City Clerk is hereby directed to send a copy of this Resolution by United States mail to the Florida Department of Revenue, the Broward County Director of the Department of Revenue Collection, and the Broward County Property Appraiser by January 10, 1996. SECTION 6: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 7: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. �l K, Temp. The City Commission will consider the adoption of a resolution electing to use the uniform method of collect- ing such assessments authorized by Section 197.3632, Flor- ida Statutes, at a public hearing, to be held at 7:30 p.m., December 13, 1995, in the Commission Chambers of City Hall located at 7525 N.W. 88th Avenue, Tamarac, Florida. Such resolution will state the need for the levy- and wily contain a Legal '`description of the .boundaries of the real properky subject to the levy. Copies of the proposed form of resolution, which contains the legal description of the real proper subject to the jevy, are on. file at `the ,Office 'of the City Clerk, City of Tamarac, ;located at 7525 N.W. 88th Ave- nue, Tamarac, Florida.
