R-95- 6(o A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING LUTZ PETROLEUM EQUIPMENT INSTALLATION, INC. TO INSTALL A ONE THOUSAND GALLON CONVAULT DIESEL TANK AND REMOVE THE EXISTING UNDERGROUND TANK AT FIRE STATION #1 UTILIZING THE PALM BEACH COUNTY SCHOOL BOARD BID AT A TOTAL COST OF $31,350; FUNDING IN THE AMOUNT OF $28,340 IS BUDGETED UNDER ACCOUNT #001-888-539-61D ENTITLED, "LIQUEFIED PETROLEUM GAS GENERATORS," $3,010 WILL BE TRANSFERRED TO THIS ACCOUNT FROM ACCOUNT #001-223-522-503 ENTITLED "MAINTENANCE LAND AND BUILDINGS" UPON COMMISSION APPROVAL; PROVIDING FOR CONFLICTS, PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the removal of the underground tank by December 1995 is required by the Department of Natural Resource Protection; and WHEREAS, Lutz Petroleum Equipment Installations has offered to extend the terms and conditions of the Palm Beach County School Board Bid to the City of Tamarac; and WHEREAS, the total cost will be $31,350.00 and is funded under Account No. 001-888- 539-61 D entitled, "Liquefied Petroleum Gas Generators," in the amount of $28,340 and funding in the amount of $3,010 will be transferred from Account No. 001-223-522-503 entitled "Maintenance Land and Buildings;" and WHEREAS, it is the recommendation of the Fire Chief and the Purchasing Officer that this purchase be awarded to Lutz Petroleum Equipment Installations; and WHEREAS. City Code §6-154 allows the Purchasing Officer to join with other units of Government in cooperative purchasing when the best interest of the City will be served; and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interest of the of the citizens and residents of the City of Tamarac to authorize Lutz Petroleum Equipment Installation to remove the existing underground diesel tank and install a one thousand gallon convault diesel tank at Fire Station #1. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF TAMARAC. FLORIDA. - 1 - Temp Reso No. 6995 Revised - 04/03/95 1 SECTION 1: The foregoing 'WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION Zi That Lutz Petroleum Equipment Installation is authorized to install a one thousand gallon convault diesel tank and to remove the existing diesel tank at a cost of $31,350.00 under the terms and conditions of the Palm Beach County School Board Bid, SECTION_ Lutz Petroleum will secure all necessary permits prior to beginning work. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTIQN If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
