CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-95-6 q
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA AUTHORIZING THE CITY
MANAGER TO NEGOTIATE OPTIONS FOR THE
ACQUISITION OF NECESSARY RIGHTS -OF -WAY
EASEMENTS, DEDICATIONS AND DEVELOPER
AGREEMENTS IN CONJUNCTION WITH THE
CONSTRUCTION OF HIATUS ROAD IN ACCORDANCE WITH
FLORIDA STATUTES; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, it is proper to utilize public funds for public purposes, and
WHEREAS, the City must acquire the necessary rights -of -way, easements and
dedications in conjunction with the construction of Hiatus Road, the connector road (N.W.
67th Street) and utilities, all of which are for the public purposes of improving the economic
well-being of the City of Tamarac; and
WHEREAS, the Land Section 7 projects will stimulate the City's economy by
opening this corridor to commercial and industrial establishments; and
WHEREAS, economic well-being is one of the main concerns of modern cities; and
WHEREAS, the City of Tamarac has officially adopted a comprehensive plan,
including a traffic ways element, pursuant to the local government comprehensive plan,
and all segments of the public were offered an opportunity to participate in the planning
process leading to adoption of the document; and
WHEREAS, the City of Tamarac has determined that Hiatus Road, the connector

road (N.W. 67th Street) and utility easements/right-of-way are consistent with the goals,
objectives and policies of the Tamarac Comprehensive Plan; and
WHEREAS, the City Manager recommends that the City Commission approve this
Resolution to authorize the City Manager or his agents to negotiate options for all
necessary rights -of -way, easements, dedications, and developer agreements in
conjunction with the development of Land Section 7 in accordance with Florida Statutes,
subject to the approval of the City Commission; and
WHEREAS, it is the recommendation of the City Mamager that he be permitted to
hire a qualified right-of-way agent to assist in the acquisition of rights -of -way, easements,
etc. necessary and appropriate for Land Section 7; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens of the City of Tamarac to approve the recommendation of
the City Manager.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Manager is hereby authorized to negotiate contracts for
the acquisition of all necessary rights -of -way, easements, and dedications in conjunction
with the construction of Hiatus Road, the connector road (N.W. 67th Street) and the utilities
in accordance with Florida Statutes and is authorized to hire a qualified right-of-way agent

to assist the City.
SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: The City Clerk is hereby authorized and directed to record this
Resolution in the Public Records of Broward County.
SECTION_6: This Resolution shall become effective immediately upon its passage
and adoption.
