RESOLUTION NO. R-95--
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, DENYING
AN AMENDMENT TO THE JULY 24, 1986
AGREEMENT RELATED TO CASE 72-11731
BETWEEN THE CITY AND THE OWNERS OF
THE FRIEDES COMMERCE CENTER, 7401 NW
88 AVENUE, TO ALLOW FOR THE STORAGE
OF BOATS AND RECREATION VEHICLES;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of
Tamarac, Florida, a public meeting has been advertised in accordance with applicable code
sections of the date, time and place of the meeting regarding this request; and
WHEREAS, the City Commission has examined the applicant's letter dated March 10,
1995 and staff recommendation dated March 29, 1995; and
WHEREAS, the City Commission has determined that the request is not in full
compliance with all elements of the Comprehensive Plan; and
WHEREAS, pursuant to paragraph II of the agreement, the agreement may be modified
only if both parties agree; and
WHEREAS, the Director of Community of Development recommends denial of the
amendment; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it not to be in
the best interests of the citizens and residents of the City of Tamarac to grant an amendment
to the agreement to Case 72-11731 to allow for the storage of boats and recreation vehicles

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and is hereby made a specific part of this Resolution.
SECTION 2: The City Commission hereby denies an amendment to the July 24,
1986 agreement related to Case 72-11731 to allow storage of boats and recreation vehicles
on the property described in Exhibit "A", pursuant to paragraph 11 of the agreement.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECIIQN 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
