A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA;
APPROVING A MINOR DELEGATION
REQUEST TO REMOVE A TRAFFICWAYS
NOTE FROM THE FACE OF THE LAND
SECTION 6 NORTH PLAT, ACCORDING TO
THE PLAT THEREOF, AS RECORDED IN
PLAT BOOK 153, AT PAGE 20, OF THE
PUBLIC RECORDS OF BROWARD COUNTY,
FLORIDA, LOCATED ON THE SOUTHEAST
CORNER OF THE SAWGRASS
EXPRESSWAY AND SOUTHGATE
BOULEVARD (SANIBEL); PETITION NO. 1-
P-95; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FQR AN EFFECTIVEDATE.
WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of
Tamarac, Florida, a public meeting has been advertised in accordance with applicable
code sections of the date, time and place of the meeting regarding delegation requests;
and
WHEREAS, the City Commission has examined the application and staff
recommendation dated March 31, 1995; and
WHEREAS, the City Commission has determined that the application is in
compliance with all elements of the Comprehensive Plan for the development that is the
subject of the application; and

WHEREAS, at the time the plat was recorded, Broward County did not have the
benefit of a conceptual site plan for the proper determination of entrance openings; and
WHEREAS, the property owner desires to remove the trafficways note from the
recorded plat; and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to approve this
delegation request;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and is hereby made a specific part of this Resolution.
SECTION 2-. That the City Commission hereby approves the delegation
request to remove the trafficways note on the Land Section 6 North Plat according to the
plat thereof as recorded in Plat Book 153 at Page 20 of the public records of Broward
County, Florida. The plat notation being removed reads as follows:
The minimum distance from the ultimate right of way of the trafficway, at any ingress
or egress driveway, to the outer edge of any interior service drive or parking space
with direct access to such driveway shall be 100 feet.
SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are

hereby repealed to the extent of such conflict.

5ECTION 5: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION Q:

This Resolution shall become effective immediately upon its
