R-95- V A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA SELECTING AN OPTION REGARDING THE PROVISION OF EMERGENCY MEDICAL SERVICES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City has been advised that the Broward County Commission contemplates taking action on ALS/EMS alternatives on May 9, 1995; and WHEREAS, the City of Tamarac needs to select how it proposes to proceed; and WHEREAS, the following are the alternatives: Option #1: The City continue as it is today, taking no action until September, 1995. At that time the City must advise the County if the City intends to (A) proceed independently by providing its own ALS/Transport System or (B) join the County MSBU (which means the City will be ALS First Responder, only). The effective date to begin either service is October 1, 1996. Option #2: (A) The City requests the County Commission on May 9 to give the City a Class 8 Certificate of Need (CON) effective as soon as possible and no later than May 31, 1995. This permits the City to provide ALS First Responder with existing City fire equipment/personnel and therefore receive the approximately $65,000 that will be available to each engine for cities that select this option. The funds are to equip existing City equipment/personnel to meet ALS standards. If this selection is made, the City still 2 Temp. Reso. #7056 Rev. 4/27/95 must select from two alternatives for the future, either of which must begin October 1, 1996: (B) to provide an independent ALS/Transport System (Class 1 CON) or (C) join the County MSBU (which means that the City will provide ALS First Responder Service). If the City elects to proceed immediately with the ALS First Responder option, the County will permit the County Director of EMS and City Fire Chief to negotiate how and when the City will provide the ALS First Responder Service. (At the present time the City does not have enough personnel trained to provide ALS First Responder on all shifts, all the time.) Option #3: The County has advertised an ordinance and may be prepared to give the City a Class 1 Certificate of Need on May 9, thereby permitting the City to proceed to provide an independent ALS/Transport System effective October 1, 1996. The City can request the Class 8 CON to be effective October 1, 1995 and simultaneously request the Class 1 CON to be effective October 1, 1996. WHEREAS, it is the recommendation of the Fire Chief and City Manager that Option 2A be selected and that the City Commission request the CON Class 8 to be effective October 1, 1995 or earlier, if possible; and WHEREAS, it is the recommendation of the Fire Chief and City Manager that the City Commission request the County Commission to table the City's request for a Class 1 CON until further notice. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and 1 3 Temp. Reso. #705� Rev. 4/27/95 confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTI N 2: That the Tamarac City Commission selects Option #2(A) as previously before written. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
