R-95--t6 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE ADDENDUM NO.95-04 TO THE ENGINEERING SERVICES AGREEMENT WITH HAZEN & SAWYER, P.C. TO PREPARE A REMEDIAL ACTION PLAN, PREPARE REIMBURSEMENT APPLICATIONS, PREPARE CONTRACT DOCUMENTS, AND ASSIST IN PUBLIC BIDDING OF THE PROJECT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDINQ AN EFFECTIVE DATE. WHEREAS, the Broward County Department of Natural Resource Protection (BCDNRP) requires preparation and submittal of a Remedial Action Plan (RAP) Report for the Tamarac Municipal Parking Lot site; and WHEREAS, it is the recommendation of the Public Works Director and the City Engineer to execute Addendum No. 95-04 to the Engineering Services Agreement with Hazen & Sawyer, P.C. for $37,000 to prepare: 1) a Remedial Action Plan; 2) documentation and applications to receive reimbursement from the State; 3) plans, specifications and bid documents to publicly advertise the project in the newspaper; and 4) assist the City in the bid process. Account No. 001-888-539-61B titled "Municipal Parking Lot Remediation" has been established for this project and has a current budget of $100,000; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to execute Addendum No. 95-04 to the Engineering Services Agreement with Hazen & Sawyer, P.C. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1_: That the appropriate City Officials are hereby authorized to execute Addendum No. 95-04 to the Engineering Services Agreement with Hazen & Sawyer, P.C. in the amount of $37,000 for the preparation of Remedial Action Plan, documentation and applications to receive reimbursement from the State, plans, specifications and bid documents to publicly advertise the project in the newspaper and assist the City in the bid process for the Tamarac Municipal Parking Lot, a copy of which is attached as "Exhibit 1." -1- 1 Temp. Reso 7027 SECTION 2: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 3: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portion or applications of this Resolution. Colombia MIEN AND SAWYER /?. 95 - 7 d 0 ADDENDUM NO. 95-04 March 23, 1995 CITY OF TAMARAC MUNICIPAL PARKING LOT, PHASE III TASK SCHEDULE Task Time of Order General Description Performance(') Compensation (2) The Broward County Department of Natural Resource Protection (BCDNRP) has requested that a Remedial Action Plan (RAP) for the clean up of contaminated groundwater be submitted for the Tamarac Municipal Parking Lot by April 1, 1995. The RAP is a formal report that outlines how the site is to be cleaned up (utilizing the information collected during the Contamination Assessment), including descriptions of the equipment, alternative system designs, the rationale for the selected clean-up method, a chosen preliminary system design, a monitoring plan, and projected capital and operational costs. A cost comparison with one or more alternatives is required. Remedial Action Plan 60 Days $18,000 Hazen and Sawyer, P.C. shall retain the services of Geraghty & Miller to develop a RAP at the Municipal Parking Lot. The RAP shall be submitted to BCDNRP for approval and sealed by a Florida -registered Professional Engineer. 2 Prepare Reimbursement Applications 90 Days $ 9,000 At this time, the City is eligible to file for reimbursement of the expenses incurred for performance of the Contamination Assessment Report (CAR) at the Municipal Parking Lot. Hazen & Sawyer, P.C. shall provide the service of filing all of the necessary reimbursement request documents to the State for the City. The costs for preparation of the reimbursement documents are reimbursable by the State. After the completion of the RAP, an additional application for reimbursement shall be made to the state. Included in the cost of each application is the services of an independent Certified Public Account (CPA) firm. Total $37,000 Notes: (1) Time of performance is measured subsequent to the notice to proceed. (2) Compensation refers to a not -to -exceed amount for the task.
