CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-95-cf/
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO ACCEPT AND EXECUTE CONTRACT AMENDMENT
HAI#95-086.00 TO THE AGREEMENT WITH HARTMAN AND
ASSOCIATES TO UPDATE THE WATER AND WASTEWATER RATE AND
CHARGE STUDY FOR TAMARAC UTILITIES EAST AND UTILITIES
WEST; PROVIDING FOR CONFLICTS, PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Hartman and Associates, Inc., in June 1992, performed a study of
water and wastewater rates for the City of Tamarac which proposed rates and charges for
services that are necessary to meet the expenditure requirements of the Utility; and
WHEREAS, increasing numbers of utility customers as a result of new development,
projected capital improvements addressing deteriorating infrastructure and more stringent
environmental regulations with declining federal assistance merits a review of water and
wastewater charges; and
WHEREAS, a periodic review of water and wastewater rates and revenue recovery
is necessary to ensure operational requirements are met and system maintenance is
provided at peak efficiency no less frequently than every two years; and
WHEREAS, the study will address objectives considering 1) rates based on cost of
service principles 2) no subsidization of costs between utilities 3) compliance with rate
covenant requirements of bond resolution 4) adequate levels of renewal and replacement
reserves, and 5) competitiveness with neighboring utilities; and

WHEREAS, a study now would provide results for implementation in fiscal year
1996, four years subsequent to the last review and implementation; and
WHEREAS, it is the recommendation of the Finance Director and Utilities Director
that amendment HAI#95-086.00 for the preparation of the Tamarac Utilities East and
Utilities West Water and Wastewater Rate Study between the City of Tamarac and
Hartman and Associates be approved and also providing for continuing miscellaneous
consulting services and rate review should the City so elect in the future; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in the best
interest of the citizens and residents of the City of Tamarac to accept and execute contract
amendment HAI#95-086.00 to the agreement with Hartman and Associates to prepare a
Water and Wastewater Rate Study for Tamarac Utilities East and Utilities West.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing whereas clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this resolution
upon adoption hereof.

and execute contract amendment HAI#95-086.00 (attached hereto) with Hartman and
Associates, Inc. for the preparation of an updated Water and Wastewater Rate Study for
Tamarac Utilities East and Utilities West for an amount not to exceed $14,611 to be funded
from Account Number 425-362-536-310 entitled Professional Services and Account
Number 419-301-536-318 entitled Engineering Services.

SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4s If any clause, section, other part or application of this resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
resolution.
SECTION 5_ This resolution shall become effective immediately upon its
passage and adoption.

Subject: Fiscal Year 1996 Rate Review
Dear Mr. Hawthorne:
This letter constitutes Hartman & Associates, Inc. (HAI's) proposal to serve the City of Tamarac
relative to the rate review for Fiscal Year 1996. We will continue to abide by the original
contract terms and conditions which we had between the City of Tamarac and HAI during our
original rate and charge engagement.
This letter constitutes an amendment to that contract, providing an up -set limit and scope of
services, and schedule of activities and hourly rate table.
Scope of Servim
HAI will review the budget information for the City of Tamarac, Florida, for Fiscal Year 1996,
and review the anticipated increases in costs due to inflationary pressures, regulatory concerns,
contractual obligations, and/or financing requirements of the City. HAI will review the historical
sales of service for the past two (2) years and project the new sales from service for Fiscal Year
1994, with the present rates and the hypothecated recommended rates and charges. The review
process will also consist of projecting fiscal requirements for Fiscal Year 1996, review of current
levels of Renewal and Replacement (R&R) reserves and recommendation of other levels of R&R
as necessary. HAI will be providing a rate review and if necessary an across-the-board rate
adjustment. Additionally, impact fees will also be reviewed to determine the appropriate levels.
Previously, HAI provided for a conservation block rate structure, a proper rate structure
responding to water conservation, and other rate structure improvements which the City adopted
and put into effect. Therefore, we believe it is necessary to only review the adequacy of rate
recovery to meet the Fiscal Year 1996 requirements. However, based on our findings and input
from the City, certain rate structure modifications/adjustments may be identified and
recommended for the Tamarac East Utility System.
HAI will prepare a rate review report and briefing document for presentation to the City
Commission workshop. The briefing document will summarize the major factors involving the
need for rate recovery, and summarize the existing and proposed rates. HAI will also perform a
rate survey in the area to compare the existing and proposed rates to rates and charges of other
communities in the area, together with providing general comments as to what may be affecting
material rate differences among the communities. This rate review is not inclusive of capital

10 charges, miscellaneous charges, miscellaneous fees, and other minor charge review; rather, this
study will include an overview of the impact fees and monthly rates to ensure adequate recovery
for services provided.
HAI will also review the historical years' performance relative to the bond covenants and the
Fiscal Year 1994 performance versus bond covenants, and a hypothecated Fiscal Year 1996
utility system performance versus bond covenants. HAI will update the City of Tamarac rate
model with the new budgetary, statistical, and operational information.
HAI will provide five (5) copies of a draft rate review report for staff review and comments, and
fifteen (15) copies of a final rate review report for City use. HAI will complete the rate review
within 55 days of receipt of an executed contract. This schedule assumes that the data requested
will be provided to HAI in a timely fashion for prosecution of this work.
This contract amendment is for the amount of $14,610,20. We appreciate the opportunity to
provide this rate study amendment for Fiscal Year 1996 to you. We appreciate the opportunity to
serve the City of Tamarac and provide the technical expertise which you desire.
