CITY OF TAMARAC
RESOLUTION NO, R-95- V
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AMENDING RESOLUTION
NO. R-94-210, RATES, CHARGES AND PROCEDURES
APPLICABLE TO TAMARAC UTILITIES WEST
MODIFYING SECTION III.C., DELINQUENT SERVICE
CHARGES; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in February 1992, a tagging system was initiated for delinquent
accounts whereby after forty-five (45) days, a tag is placed giving delinquent customers
twenty-four (24) hours to pay the amount due or warning discontinuance of service,
and
WHEREAS, the Finance Department and Utilities Department have reviewed the
charges and procedures governing delinquent accounts of Tamarac Utilities West for a
more efficient and effective process; and
WHEREAS, it is the recommendation of the City Manager, Finance Director and
the Utilities Director to amend Resolution No. R-94-210, Section III C., Delinquent
Service Charges, to implement the mailing of a late notice at thirty-one (31) days after
the bill is rendered replacing the tag notice at forty-five (45) days and the
implementation of a late payment charge; and
WHEREAS, the City Commission has considered the proposed change in
procedures in administering delinquent charges along with input from City Staff and
members of the public; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems this
resolution to be in the best interest of the residents and City of Tamarac.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
Section 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
resolution.
Section 2: Section III C., second paragraph of Resolution No. R-94-210 will

"if the customer has not paid the current bill within 30 days of the
date the bill is rendered, the City will notify the customer of their
delinquency and inform them that if payment is not received and
posted by a specific date and time on or before 45 days from the
original rendering date, service shall be discontinued. A late
payment charge of 10 percent of the bill will be applied at 31 days
and a delinquency charge as noted above will be applied at 45
days. rr
Section 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
Section : If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

Section 5: This Resolution shall become effective for all Tamarac Utilities
West customers on or after June 1, 1995.
