A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA, APPROVING AN ENCROACHMENT OF 1-
FOOT INTO THE 5-FOOT SIDE YARD UTILITY EASEMENTS OF
VARIOUS HOMES IN AVALON AT WOODMONT (TRACT 56)
FOR THE LOCATING OF AIR CONDITIONING UNITS; PETITION
NO. 1-P-94; PROVIDING FOR CONFLICTS;, PROVIDING FOR
SEVERABILITY: ALUP-ROVIDINQ AN -EFFECTIVE DATE,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the City Council hereby approves an
encroachment of 1-foot into the 5-foot side yard utility easements of
various homes in Avalon at Woodmont (Tract 56) for the locating of air
conditioning units, Petition No. 1-P-94, as described in Exhibit 1,
attached.

This Resolution will be contingent upon the
Lot 1 be restricted to the South side.
Lot 2 be restricted to the North side.
Lot 17 be restricted to the South side.

d. Lot 29 be restricted to the rear of the
property. Pending verification of proper
setbacks.
e. Lot 31 be restricted to the West side.
f . Lot 33 be restricted to the East side.
g. Lot 34 be restricted to the South side.
h. Lot 35 be restricted to the North side.
i . Lot 47 be restricted to the South side.
For each of the restrictions provided above, the City Manager or
designee may, on a case -by -case basis, modify the restrictions upon
submittal of a written request by developer and review and written
approval by the appropriate utility companies.
SECTION 3: All Resolutions or parts of Resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION4: If any clause, section, other part or application of this

Resolution is held by any court of competent jurisdiction to be
unconstitutional or invalid, in part or application, it shall not affect the
validity of the remaining portions or applications of this Resolution.

SECTION 5: This Resolution shall become effective
immediately upon adoption.
