CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-94- /dw
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AN AGREEMENT WITH BELL
SOUTH MOBILITY TO PLACE AN ANTENNA ON CITY
PROPERTY, PROBABLY ON TRACT 27, PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PELQVIDINQ FOR AU EFFECTIYE DATE.
WHEREAS, Bell South Mobility has approached the City over a period
of time attempting to negotiate an agreement whereby an antenna can be
placed somewhere on City property, probably on Tract 27; and
WHEREAS, Bell South Mobility has alleged that by locating an
additional antenna in this area of the City the quality of mobile telephone
reception will be enhanced; and
WHEREAS, Bell South Mobility has alleged that by locating the
antenna on City property that a benefit will accrue to the City; and
WHEREAS, it is the opinion of the City Manager that the assertions
made by Bell South Mobility are generally correct and that the City should
attempt to negotiate a contract with Bell South Mobility and that is the
City Manager's recommendation.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a
specific part of this Resolution.
SECTION 2: That the City Manager is hereby authorized to
negotiate an agreement with Bell South Mobility and to bring that to the
City Council for consideration on an appropriate agenda.
All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
aECTION 4: If any clause, section, other part or application of
this Resolution is held by any court of competent jurisdiction to be
unconstitutional or invalid, in part or application, it shall not affect the
validity of the remaining portions or applications of this Resolution.
SECTION 5: This Resolution shall become effective
immediately upon its passage and adoption.
