R-94_ /O A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE AN AMENDMENT TO THE INTERLOCAL AGREEMENT BETWEEN THE CITIES OF COCONUT CREEK, LAUDERHILL, MARGATE, NORTH LAUDERDALE, AND TAMARAC PERTAINING TO A JOINT RECYCLING PROGRAM; PROVIDING FOR 'ONFLICTS; PROVIDING FOR SEVERABILITY; AND , . .OVIDING FOR AN EFFECTIVE DATE, ._. WHER=r�S, on November 22, 1989, the City Council of the City of Tamarac, F�orida authorized Resolution No. 89-293 authorizing the appropriate C J't', Officials to execute an Interlocal Agreement between the Cities of Co -.on.ut Creek, Lauderhill, Margate, North Lauderdale, and Tamarac pertaicng to a Joint Recycling Program; and WHEREA%y, Section 3, Administration of the Joint Recycling Program Interlocal Agree Ant provides that the City Manager and in the case of Lauderhill, the Nlayror, shall represent the various cities and act as the Administrative 'committee for purposes of contract negotiation, establishment ar?:;i monitoring of recycling program guidelines and implementation of 'fhy: powers outlined in Section 2 B) of this Agreement; and 2 Temp. Reso. # ( 7 7 / WHEREAS, the Administrative Committee consists of the City Managers of the City of Coconut Creek, Margate, North Lauderdale and Tamarac and the Mayor of the City of Lauderhill; and WHEREAS, it is difficult for the Administrative Committee to meet on a regular basis without an alternative member representing that City in placing items before a vote; and WHEREAS, the City Manager recommends that each City, as a member of the Administrative Committee, have the ability to provide an alternate representative to the City Manager or Mayor, (in the case of Lauderhill). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Council hereby approves the City Manager's recommendation to amend the Joint Recycling Group Cities contract to provide for alternates in Section 3 A), and authorizes execution by appropriate City Officials, a copy of said Amendment is attached hereto as Exhibit "1 ". SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be Ll 3 Temp. Reso. #—�-Z 7/ unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. WrLl=&7Vl1l=1kfi:5 WHEREAS, GROUP CITIES entered into an Interlocal Agreement hereinafter "Agreement" on November 22, 1989, by Resolution No. 89-293, pertaining to a Joint Recycling Program; and WHEREAS, Section 3A, Administration of the Agreement provides that the City Managers and in the case of Lauderhill, the Mayor represent the various cities and act as the Administrative Committee for the purpose of contract negotiation, establishment and monitoring of recycling program guidelines and implementation; and WHEREAS, the Administrative Committee consists of the City Managers of the City of Coconut Creek, Margate, North Lauderdale and Tamarac and the Mayor of the City of Lauderhill; and 1 0 g=?� (--/07 0 WHEREAS, it is difficult for the Administrative Committee to meet on a regular basis without an alternative member representing that City in placing items before a vote; and WHEREAS, the City Manager recommends that each City, as a member of the Administrative Committee, have the ability to provide an alternate to the City Manager or Mayor, (in the case of Lauderhill). NOW, THEREFORE, in consideration of the mutual terms and conditions, promises, covenants and payments hereinafter set forth, GROUP CITIES agrees as follows: 1. That the foregoing recitals are true and correct and form part of the consideration of this Agreement. 2. That Section 3 Administration is hereby amended as follows: A) SECTIONS: ADMINISTRATION The following individuals shall represent the various cities and act as the Administrative Committee for purposes of contract negotiations, establishment and monitoring of recycling program guidelines and implementation of the powers outlined in Section 2 B) of this Agreement. The November 22, 1989 Joint Recycling Program Administration Interlocal Agreement and all subsequent amendments thereto not subject to this or other duly executed amendments remain in full force and effect. The failure to specifically delineate any prior terms or conditions in this Amendment does not operate to relieve GROUP CITIES of any obligations pursuant to the Agreement or waive any rights contained therein. IN WITNESS WHEREOF, the parties hereto have made and executed this Amendment to the Agreement between the GROUP CITIES on the respective dates under each signature; CITY OF TAMARAC through its CITY COUNCIL, signing by and through its Mayor, authorized to execute same by Council action on the day of _ 1994.
