RESOLUTION NO. R-94._, f
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA; AWARDING BID #93-09 TO THE
NEXT LOWER BIDDER, RUNWAY GROWERS, INC. FOR
THE SUPPLY, INSTALLATION AND GUARANTEE OF
TREES AND RELATED WORK FOR THE WOODMONT
70TH STREET MEDIANS PROJECT NOT TO EXCEED
$12,000.00; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFEQJIVE
WHEREAS, the City Council of
the City
of
Tamarac, Florida deems
it
to be in the best interests of the
citizens
and
residents of the City
of
Tamarac;
WHEREAS, bids were advertised in the Fort Lauderdale News/Sun
Sentinel, a newspaper of general circulation in Broward County, Florida,
on September 29, 1993 and October 6, 1993; and
WHEREAS, bids were opened on. October 15, 1993; and
WHEREAS, Reed Landscaping, Inc. was the lowest fully responsive
and responsible bidder; and
WHEREAS, Bid #93-09 was awarded to Reed Landscaping on January
12, 1994; and
WHEREAS, Reed Landscaping has not complied with the contract
terms and conditions as set forth; and

WHEREAS, Reed Landscaping did not meet the County approved
specifications; and
WHEREAS, Reed Landscaping installed approximately 2/3 of the
project trees; and
WHEREAS, on May 24, 1994 the City Manager formally terminated the
agreement between the City of Tamarac and Reed Landscaping; and
WHEREAS, the 70th Street Median Project tree planting
improvements have not been completed; and
WHEREAS, Runway Growers, Inc. is the next lowest bidder; and
WHEREAS, Runway Growers, Inc. has agreed that Runway would honor
its original bid and terms and conditions of the existing contract,
including any additional remedial action required as a result of the prior
contractor; and
WHEREAS, Broward County has extended the grant completion date to
July 1, 1994; and
WHEREAS, the Consulting Landscape Architect, Purchasing Officer,
Assistant City Manager and the City Manager hereby recommend that the
bid be awarded to the next lowest bidder in an amount not to exceed
$12,000.00; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:

SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific
part of this Resolution.
SECTION 2: That the bid be awarded to the next lower bidder, Runway
Growers, Inc. for the supply, installation and guarantee of trees and
related work for the Woodmont 70th Street Medians.
That the funds not to exceed $12,000.00 are to be
allocated for this Project from Grant Funding, Account Woodmont
Streetscape Project No. 153-071-539-4RH.
SECTION -A;, That the appropriate City officials are hereby authorized
to execute the all documents in connection with this bid.
SECTION 5: All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be
unconstitutional or invalid, in part or application, it shall not affect the
validity of the remaining portions or applications of this Resolution.
SECTION 7: This Resolution shall become effective immediately upon
its passage and adoption.
