R-94- // 9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE CITY MANAGER TO SEND A PROPOSED MILLAGE RATE OF 5.9999 TO THE PROPERTY APPRAISER FOR FISCAL YEAR 1995 AND TO SET A DATE, TIME AND PLACE FOR THE FIRST PUBLIC BUDGET HEARING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statute 200.065 (TRIM - Truth in Millage) requires all municipalities, within 35 days of receipt of certification of value (on or around July 1), to advise the Property Appraiser of an estimated millage rate to be included in the TRIM notice sent to each taxpayer; and WHEREAS, an estimated and tentative millage rate should be proposed which would allow the City Council latitude in meeting fiscal year 1995 budgetary requirements; and WHEREAS, it is believed to be in the best interest of the City of Tamarac to allow the City Manager to send an estimated and tentative millage rate of 5.9999 to the Property Appraiser which may be adjusted downward and failure to provide this information prohibits levying a millage rate greater than the rolled -back millage rate; and WHEREAS, Florida Statute 200.065 requires that a hearing date, other than that scheduled by the County Commission and School Board, be set by each municipality to be included in the TRIM notice sent to each taxpayer. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: Temp. Reso. # 6, %G Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: The City Manager is authorized to send notification to the Property Appraiser of the estimated millage rate of 5.9999 for fiscal year 1995 along with the date, time and place of the first Public Budget Hearing being Monday, September 12, 1994 at 5:05 P.M. at the City of Tamarac Council Chambers, 7525 N.W. $Sth Avenue, Tamarac, Florida 33321. Section 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 TEMP.
