R-94- 15Y A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE CITY MANAGER TO APPLY FOR FINANCIAL ASSISTANCE FROM THE UNITED STATES INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT (ISTEA) THROUGH THE BROWARD COUNTY METROPOLITAN PLANNING ORGANIZATION (MPO) FOR A TRANSPORTATION ENHANCEMENT PROJECT TITLED "SOUTHGATE BOULEVARD PEDESTRIAN AND BICYCLE CORRIDOR"; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Tamarac, Florida has determined the Southgate Boulevard Pedestrian and Bicycle Corridor project to be an important transportation enhancement priority; and WHEREAS, the City of Tamarac, Florida is requesting the Southgate Boulevard Pedestrian and Bicycle Corridor project be considered and placed on the Broward County Metropolitan Planning Organizations (MPO) enhancement cycle 1994 priority projects lists; and WHEREAS, it is a requirement of the program that this Resolution be adopted and become an official part of the application; and 1 Revised 8/17/94 Temp. No. 6803 WHEREAS, the Director of Planning recommends approval of this request; and WHEREAS, the City of Tamarac, Florida is willing to contribute local funds in the minimum amount of $35,000.00 for financial assistance to the Southgate Boulevard Pedestrian and Bicycle Corridor project; and WHEREAS, City of Tamarac, Florida wishes to encourage additional support for the Southgate Boulevard Pedestrian and Bicycle Corridor project by other interested parties; and WHEREAS, the City of Tamarac has an officially adopted local comprehensive plan, including a trafficways element, pursuant to the Local Government Comprehensive Planning Act, and all segments of the public were offered an opportunity to participate in the planning process leading to the adoption of this document; and WHEREAS, the City of Tamarac has determined the Southgate Boulevard Pedestrian and Bicycle Corridor project to be consistent with the Goals, Objectives and Policies of the Tamarac Comprehensive Plan; and WHEREAS, the City of Tamarac is in a fiscally and legally responsible position to satisfactorily develop, operate and maintain the project in accordance with the program requirements; and 2 Revised 8/17/94 Temp. Reso. No. 6803 WHEREAS, the City Manager is authorized to accept and execute all appropriate documents and contracts for the purpose of administrating the funding. NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. SECTION 2: That the City Manager is hereby authorized to request consideration and placement of the Southgate Boulevard Pedestrian and Bicycle Corridor Project on the Broward County MPO's Transportation Enhancement Priority Project Lists, for funding under the Intermodal Surface Transportation Efficiency Act (ISTEA). SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 3 11 1 Revised 8/17/94 Temp. If the City of Tamarac does not have the staff available, the City will contract with the proper agencies to complete the project. The City of Tamarac intends to meet or exceed all standard provisions for the accommodation of pedestrians and bicycles along the roadways with this project. B. This project will meet or exceed the most recently -approved planning and design requirements as follows: 1. American Association of State Trans ortation Officials AASHTO Guide to Bigycle Facilities. 2. Federal Highway Administration FHWA Standards for Pedestrians. 3. FDOT's Florida Pedestrian Safety Plan. 4. Americans with Disabilities Act Architectural Guidelines. C. The City of Tamarac will submit a written commitment to maintain and operate the bicycle and pedestrian facilities in perpetuity when requested to do so. D. The bicycle and pedestrian facilities are compatible with the goals, objectives and policies found in the City of Tamarac Comprehensive Plan, especially in the future land use element and traffic circulation element. E. All bicycle and pedestrian facilities and their features will be available to the general public during normal operating hours. F. Map of the proposed improvements is attached. I* 0 41 EXHIBIT C cont. Provisions for Landscape Improvements A. The City intends to utilize the funds for new landscaping on proposed facility improvements. This project will not include any routine landscaping. B. The proposed project will: 1. Be professionally designed by a registered landscape architect. 2. Provide for period of plan establishment and perpetual maintenance; and 3. The landscaping will conform to all safety standards in accordance with Hichway Landsraping, Roadway and Iraffic 12csimrSafety C. The City of Tamarac plans to include the landscaping under the approved City list of landscape materials. All irrigation will be well -style irrigation for all medians with vegetation. Approximate number of plants include five hundred (500) trees, one thousand (1,000) shrubs from the approved plant list. D. The City of Tamarac will supply a written commitment to maintain the landscape in perpetuity.
