RESOLUTION NO. R-94-Aek
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA, ISSUING
DEVELOPMENT ORDER NO. 052-2 AND MAJOR
REVISED SITE PLAN APPROVAL FOR
PICCADILLY CAFETERIA TO PERMIT AN
EXPANSION OF 1,385 SQUARE FEET OF AREA
BY ENCLOSING THE EXISTING COVERED
WALKWAY AREA ON THE APPROVED SITE PLAN;
PURSUANT TO THE PROVISIONS OF CHAPTER
10 OF THE CODE OF ORDINANCES OF THE CITY
OF TAMARAC, FLORIDA; PETITION NO. 21-SP-
94; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City Council of
Tamarac, Florida, a public meeting has been advertised in accordance
with applicable law of the date, time and place of the meeting
regarding the review of the application for a revised development
order by the applicant for development approval; and
WHEREAS, the Development Review Committee recommended
approval of this site plan on June 3, 1994; and
WHEREAS, the Planning Commission recommended approval
unanimously on July 6, 1994; and
WHEREAS, the City Council has examined the application, the
staff and Planning Commission recommendations, and the attached
Development Review Status Sheet dated July 13, 1994; and
WHEREAS, the City Council reviewed this development order,
and accompanying documents at a public meeting; and

WHEREAS, the Director of Planning recommends approval of
this request; and
WHEREAS, the City Council has determined that the
application is in compliance with all elements of the Comprehensive
Plan, or will be in compliance prior to the issuance of a Certificate
of Occupancy for the development that is the subject of the
application; and
WHEREAS, the City Council of the City of Tamarac, Florida
deems it to be in the best interests of the citizens and residents of
the City of Tamarac to issue Development Order No. 052-2 which is
for a revised site plan approval for a 1,385 square foot expansion to
the Piccadilly Cafeteria;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1_ The

ratified and confirmed
as being
correct and
are hereby
made a
specific part of this resolution.
aCTIQN 2: That the application for approval of the revised
site plan for entitled "Modification to Existing Piccadilly Cafeteria",
as prepared by VIE Architectural Design, Inc., dated last revised May
9, 1994 , is HEREBY APPROVED subject to the following conditions:
A. Construction is to be in complete compliance with the
plans and specifications submitted by the developer to the City of

Tamarac as described in Section II of the Development Review
Status Sheet and approved engineering drawings.
B. Commencement of construction shall begin no later than
one year from the date of this approval. If the development does not
commence construction within one year, this approval is null and
void unless an extension has been granted in accordance with
applicable regulations.
C. The development order is assignable, but an assignment
does not discharge any assignee from strict compliance with the
order unless the City Council consents to modify any of the original
requirements.
D. Prior to the issuance of Building Permits, Local Traffic
Impact Fees in the amount of $1, 202.18 shall be paid to the City.
E. No Building Permit shall be issued until the plat notation
which limits the amount of square footage has been amended by the
City and Broward County to allow the proposed expansion.
SfLTION 3: All Resolutions or parts of Resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTIQN 4: If any clause, section, other part or application of
this Resolution or Development Order is held by any court of
competent jurisdiction to be unconstitutional or invalid, in part or

application, it shall not affect the validity of the remaining portions
or applications of this resolution or development order.
SECTION 5: This Resolution shall become effective
immediately upon adoption.
