R-94- A� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA, DECLARING THE RESULTS OF THE SPECIAL ELECTION VOTING AT THE SEPTEMBER 8, 1994 ELECTION ON AMENDMENTS TO THE CITY CHARTER 1-9/94 (SECTION 12.12), 2-9/94 (SECTION 6.03), 3-9/94 (SECTION 4.04) AND 4-9/94 (SECTION 8.01); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING -AN EFFEQTIVE DATE. WHEREAS, a Special Election was held on September 8, 1994, wherein the electorate was asked to vote on amendments to the Charter of the City of Tamarac; and WHEREAS, the Broward County Canvassing Board has canvassed the results of the machine voting and absentee ballots and has certified such results to the City Clerk of the City of Tamarac; and WHEREAS, the City Clerk has reviewed the certification from the Broward County Canvassing Board and has presented their findings to the City Council for a formal Certification and Declaration of the results. WHEREAS, the City Council of the City of Tamarac, Florida, deems it to be in the best interests of the citizens and residents of the City of Tamarac to declare the results of the Special Election voting at the September 8, 1994 election on amendments to the City Charter 1-9/94 (Section 12.12), 2- 9/94 (Section 6.03), 3-9/94 (Section 4.04) and 4-9/94 (Section 8.01). 1 Temp Reso. #6835 1-1 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the following is hereby certified and declared as the official results of the public vote at the Special Election of September 8, 1994, for the proposed Charter Amendments: AMENDMENT 1-9/94: Amendment to Section 12.12 of the City Charter is added changing City Council to City Commission and changing Councilmembers, Councilwomen and Councilmen to Commissioners. YES 4118- NO 2530 AMENDMENT 2- 94: Amendment to Section 6.03 of the City Charter is amended to eliminate Charter Board appointments to the Redistricting Committee; the number of members is reduced from nine (9) to five (5) and the number of votes needed to adopt a report is reduced from five (5) to three (3). YES 3486 NO 3100 1 Temp Reso. #6835 AMENDMENT 3-9/94: Amendment to Section 4.04 of the City Charter is amended to increase salaries for offices of Mayor and Councilmembers from salaries set in 1981. Councilmembers' salary increased from $3,600.00 to $8,750.00 per year paid monthly. Mayor's salary increased from $4,800.00 to $11,000.00 per year paid monthly. YES 2195 NO 4595 AMENDMENT 4-9/94: Amendment to Section 8.01 of the City Charter is amended to change selection of Charter Board members from two (2) year elected terms to appointment by Council. Current Charter Board members may complete their terms. Appointment of members begins as current Charter Board members vacate positions. All appointments for three year terms starting March, 1996 following transition period. Appointed Charter Board members may be removed by majority vote of Council. YES 2939 NO 3669 SECTION 2: That Amendments to the City Charter Numbers 1-9/94 and 2-9/94, having received approval of a majority of the voters voting on these amendments, do become a part of the existing City Charter of the City of Tamarac, which was adopted at the General Election held on March 9, 1976 and subsequently amended. 1 3 Temp Reso. #6835 1 1 SECTION 3: That Amendments to the City Charter Numbers 3-9/94 and 4-9/94, not having received approval of a majority of the voters voting on these amendments, do not become a part of the existing City Charter of the City of Tamarac, which was adopted at the General Election held on March 9, 1976 and subsequently amended. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, or other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
