R-94- 177 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE AND ACCEPT A COVENANT WITH PULTE HOME, INC. TO PLANT LANDSCAPING, TREES, SHRUBS, CONSTRUCT SIGNS AND DECORATIVE ROADWAY IN THE ENTRANCEWAY OFF OF NOB HILL ROAD FOR THE PLUM BAY DEVELOPMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.. WHEREAS, the City Council of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to execute a Hold Harmless Agreement with Pulte Home, Inc. WHEREAS, it is the recommendation of the Director of Public Services that this Hold Harmless Agreement with Pulte Home, Inc. to plant landscaping, trees, shrubs, construct signs and decorative roadway in the entranceway off of Nob Hill Road for the Plum Bay Development be approved. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the appropriate City Officials are hereby authorized to accept and execute a covenant from Pulte Home, Inc. to plant landscaping, trees, shrubs, construct signs and decorative roadway in the entranceway off of Nob Hill Road for the Plum Bay Development, a copy of said covenant being attached hereto as "Exhibit A1l. Temp. Reso. #6823 SECTION 2: That the City Clerk is hereby authorized and directed to record said covenant in the public records of Sroward County. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portion or applications of this Resolution. RA CITY ATTORNEY 9/94 I � 9 NORMAN ABRAMOWITZ MAYOR RECORD OF COUNCIL VOTE MAYOR ABRAMOWITZ DIST. 1: V / M KATZ DIST. 2: C / M MISHKIN DIST. 3: C / M SCH EIBER DIST. 4: C / W t,4ACHEK /L.Ai -2- ` ` / EXHIBIT "A" TO RESOLUTION COVENANT KNOWN ALL MEN BY THESE PRESENTS, that the undersigned Pulte Home Corporation, a Michigan corporation, (hereinafter called "Owner") the Owner of those certain lands situated in Broward County, Florida described upon Exhibit "A" annexed hereto and made a part hereof (said property described on Exhibit "A" is a portion of that project commonly known as "The Plums" pursuant to that certain Declaration of Covenants recorded in Official Records Book 1806 at page 0001 of the Public Records of Broward County, Florida ("Declaration") which project and the property described on Exhibit "A" shall be hereinafter referred to as "The Plums") does hereby agree with the City of Tamarac, Florida, (hereinafter called "City"), that in consideration of City's permitting Owner to landscape and to plant trees and shrubs and construct signs (if permitted by the City) in the islands constructed or to be constructed within the roadway described upon Exhibit "B" annexed hereto and made a part hereof (hereinafter called the "Islands"), and the City's permitting Owner to construct a paver, stamped concrete, cobblestone or other similar decorative roadway together with related amenities including signage (if permitted by the City) in portions of the entranceway to The Plums being that portion of the roadway described upon Exhibit "B" annexed hereto and made a part hereof located between Nob Hill Road and Plum Bay Parkway in the City of Tamarac (hereinafter called the "Entranceway"), Owner will maintain all landscaping, signs, trees and shrubs placed upon the Islands and all decorative roadway, landscaping and signs placed upon the Entranceway for a period of fifty (50) years from the date hereof at the sole cost and expense of Owner and/or Association (as hereinafter described). City acknowledges that the Owner has formed a homeowners association known as The Plums Master Association, Inc., a Florida corporation not -for -profit (hereinafter called "Association") which Association pursuant to the Declaration has the responsibility to maintain the landscaping, decorative roadway and signage within the Islands and the Entranceway and the City, Owner and Association agree that after the initial installation of the Islands and the Entranceway the Owner shall be relieved of all obligations under this Covenant and the Association shall be solely responsible for all maintenance and other obligations contained in this Covenant thereafter. The City will be held harmless from the cost or obligation to restore the decorative roadway portions of the Entranceway caused as a result of repair or maintenance to the decorative roadway or public utilities within the Entranceway. .The City will also be held harmless from any claims made for any accidents or injuries arising out of any kind of impact or, obstruction caused by the landscaping, trees, shrubs and signs located within the Islands as hereinabove permitted. The Association joins in this Covenant to acknowledge the contents hereof and its obligations contained herein.
