CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-94- -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA, INCREASING THE MONTHLY RATE
FOR SOUTHERN SANITATION SERVICE FOR THE
MULTI -FAMILY SOLID WASTE SERVICE; AND
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, the City of Tamarac has a contract with Southern
Sanitation
for collection and
disposal
of solid waste from multi -family
residences
within the City of
Tamarac;
and
WHEREAS, Broward County has increased the tipping fee from $66.27
to $75.87 per ton of processable waste delivered to the Resource Recovery
System facility; and
WHEREAS, Broward County mandated that this fee increase would be
effective October 1, 1994; and
WHEREAS, Article 8 of this contract provides for certain
adjustments of the monthly rates upon notification by Southern Sanitation
that Broward County's disposal fees have increased, a copy of said notice
by Southern Sanitation dated August 5, 1994 attached as Exhibit "1 ".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:

S_ECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific
part of this Resolution.
SECTION 2: That the monthly rate for providing multi -family solid
waste service will be increased by $1.13 per yard effective October 1,

SECTION 3: All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be
unconstitutional or invalid, in part or application, it shall not affect the
validity of the remaining portions or applications of this Resolution.
SECTION ,5 This Resolution shall become effective immediately upon
its passage and adoption. ZZ.-

Dear Mr. Noe:
Based on Article 8 of our contract, the monthly rate for providing multi -family solid waste service
will be increased by $1.13 per yard effective October 1, 1994. The adjustment was computed as
follows:
Broward County's disposal fees, based on the Interlocal Agreement, will increase from
$66.27 to $75.87 per ton. The disposal pass through formula in our contract provides for
ten cents ($.10) per cubic yard plus 15 % franchise fee for each one dollar ($1.00) change
in the per ton disposal rate ($9.60 x .10/85).
