R-94-291 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA, APPROVING A MAJOR DELEGATION REQUEST TO AMEND CERTAIN NOTATIONS ON THE FACE OF THE UNRECORDED TAMARAC TRACT 24 PLAT, LOCATED AT THE SOUTHEAST CORNER OF NOB HILL ROAD AND NW 81 STREET, TO ESTABLISH A DWELLING UNIT MIX BY NUMBER OF BEDROOMS, TO DELETE REFERENCES TO THE PROJECT BEING BUILT AND OPERATED UNDER A H.U.D. PROGRAM, TO DELETE THE DESIGNATION OF TRACT D, TO AMEND CERTAIN DATES AND NAMES OF PERSONS, TO AMEND CERTAIN SURVEYOR CALCULATIONS AND NOTATIONS, AND TO AMEND CERTAIN NOTATIONS REQUIRED BY BROWARD COUNTY; PETITION NO. 7-P-94; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicable code sections of the date, time and place of the meeting regarding delegation requests; and WHEREAS, the City Council has examined the application and staff recommendation dated August 24, 1994; and WHEREAS, the Director of Planning and City Engineer recommend approval of this request; and 1 TEMP.RESO.#6818 WHEREAS, the City Council has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application; and WHEREAS, the plat notations currently include a restriction that the property is limited to 300 dwelling units (no dwelling unit breakdown), that the development is restricted to providing housing for families with a total family income of 80% or less of the median income for Froward County, according to the current standard Metropolitan Statistics of the U.S. Department of H.U.D., that a Parcel of land designated as Tract D is depicted which was to be a drainage easement and water retention area, and that certain surveyor dimensions, distances, dates and names of individuals were depicted; and WHEREAS, the owner of the subject property has requested that the unrecorded plat be amended to identify the mix of dwelling units, to delete all references to Tract D, to remove the restriction that the project would be built and operated under a U.S. Department of H.U.D. program, that a Bus Shelter Easement required by Broward County be added to the plat, and that certain surveyor modifications to dimensions, dates and names be allowed, all as specifically depicted on the plat attached hereto as Exhibit ;and N TEMP.RESO.#6818 WHEREAS, the City Council of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve this delegation request; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: E TI N 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being correct and are hereby made a specific part of this resolution. SECTIQN 2: That the City Council hereby approves the delegation request to amend certain plat notations on the Unrecorded Plat to be known as Tamarac Tract 24, as more particularly described in the legal description attached hereto and identified as Exhibit A. The modifications to the plat notations approved by the City of Tamarac are reflected on the Plat attached hereto and identified as Exhibit; and are generally described as follows: 1. This plat is restricted to 120 One Bedroom Units, 108 Two Bedroom Units and 72 Three Bedroom Units. This note is required by Chapter 5, Article IX, Broward County Code of Ordinances, and may be amended by approval of the Broward County Board of County Commissioners. The notation and any amendments thereto are solely indicating the approved development level for property located within the plat and do not operate as a restriction in favor of any property owner including the owner or owners of property within this plat who took title to the property with reference to the plat. 3 TEMP.RESO.#6818 2. Survey Note No. 7 has been added which relates to the location and elevation of a survey benchmark. 3. The name of the County Administrator and the year are changed to reflect the present Administrator and year. 4. Several amendments in the legal description to correctly identify angles and distances of plat features. 5. The square footage of Parcel A is changed to reflect the additional square footage previously within Tract D. 6. A Bus Shelter Easement located along Nob Hill Road has been added at the request of Broward County. 7. The square footage of the additional right-of-way dedication has been corrected in Survey Note No. 3. 8. Modifications to the Dedication language to identify M.G. Tract 24, Inc. as a Florida Corporation and deletion of language referring to the Corporate Seal being affixed to the Plat. 9. The note stating the development is restricted to providing housing for families with a total family income of 80% or less of the median income for Broward County, according to the current Standard Metropolitan Statistics of the U.S. Department of H.U.D. has been deleted. a C� TIONI: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. =10N 4 If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect n lu TEMP.RESO.#6818 the validity of the remaining portions or applications of this resolution .
