R-94- /99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA, APPROVING AN ENCROACHMENT OF ONE (1) FOOT INTO A FIVE (5) FOOT UTILITY EASEMENT ALONG THE SIDE (WEST) LOT LINE; LOCATION IS 7408 NW 75 STREET (LOT 26, BLOCK 1, GREENBRIER DEVELOPMENT ADDITION NUMBER ONE, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 80, PAGE 45, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA); PETITION NO. 5-P-94; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY: AND PROVIDING AN EFFE_QTJyE DATE. WHEREAS, a five (5) foot utility easement exists along the side (west) lot line of the property; and WHEREAS, the property owner has obtained the approval of the necessary utility companies to encroach into the easement; and WHEREAS, the Director of Planning recommends approval of this request; and WHEREAS, the City Council of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant this encroachment request, 1 Revised 8/16/94 Temp. No. 6808 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: S-ECIIQN• The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTIO 2: That the City Council hereby approves an encroachment of one (1) foot into the five (5) foot utility easement along the side (west) lot line of the property located at 7408 NW 75th Street (Lot 26, Block 1, Greenbrier Development Addition Number One, according to the Plat thereof, as recorded in Plat Book 80, Page 45 of the Public Records of Broward County, Florida). SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
