RESOLUTION NO. R-94-189
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA, ISSUING
DEVELOPMENT ORDER NO. 290 AND MAJOR
REVISED SITE PLAN APPROVAL FOR CITIBANK
F.S.B. (FORMERLY UNIVERSITY DINER) TO
PERMIT THE DEMOLITION OF THE EXISTING
BUILDING AND APPROVE THE CONSTRUCTION
OF A NEW BANK BUILDING WITH DRIVE-THRU
TELLERS; PURSUANT TO CHAPTER 10 OF THE
CODE OF ORDINANCES OF THE CITY OF
TAMARAC, FLORIDA; PETITION NO. 34-SP-94;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE,
WHEREAS,
pursuant
to the
instructions of the City
Council of
Tamarac, Florida,
a public
meeting
has been advertised in
accordance

with applicable law of the date, time and place of the meeting
regarding the review of the application for a development order by
the applicant for development approval; and
WHEREAS, the City Council has examined the application, the
staff and Planning Commission recommendations, and the attached
Development Review Status Sheet dated August 29, 1994; and
WHEREAS, the Director of Planning recommends approval, and
WHEREAS, the Planning Commission, on August 17, 1994
recommended approval subject to conditions;
WHEREAS, the City Council reviewed this development order
and accompanying documents at a public meeting; and

WHEREAS, the City Council has determined that the application
is in compliance with all elements of the Comprehensive Plan, or
will be in compliance prior to the issuance of a Certificate of
Occupancy for the development that is the subject of the application
by making a finding that the proposed development falls under the
provisions of Broward County's DeMinimus Rule guidelines for
arterial roadways ; and
WHEREAS, the City Council of the City of Tamarac, Florida
deems it to be in the best interests of the citizens and residents of
the City of Tamarac to issue Development Order No. 290 and grant
major revised site plan approval for a new Citibank bank building
including drive-thru tellers, revisions to parking areas, landscaping
and other site features,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: The
foregoing
"WHEREAS"
clauses are
hereby
ratified and confirmed
as being
correct and
are hereby
made a
specific part of this resolution.
SECTION 2: That the application for approval of the site plan
for a Citibank F.S.B. bank building including drive-thru tellers,
revisions to parking areas, landscaping and other site features, as
prepared by Rhon Ernest -Jones, Consulting Engineers, Inc., dated
received by the Community Development Department August 29,
1994, is HEREBY APPROVED subject to the following conditions:

A. Construction is to be in complete compliance with the
plans and specifications submitted by the developer to the City of
Tamarac as described in Section II of the Development Review
Status Sheet and approved engineering drawings.
B. Commencement of construction shall begin no later than
one year from the date of this approval. If the development does not
commence construction within one year, this approval is null and
void unless an extension has been granted in accordance with
applicable regulations.
C. The development order is assignable, but an assignment
does not discharge any assignee from strict compliance with the
order unless the City Council consents to modify any of the original
requirements.
D. The southernmost driveway (near University Drive) shall
be limited to Right-Turn-In/Right-Turn-Out vehicular traffic
movements and the appropriate pavement striping, signage or other
improvements required by the City Engineer shall be installed in
conjunction with the site improvements. All improvements shall be
made prior to the issuance of a Certificate of Occupancy.
E. NW 58th Street (Access Driveway to Midway Plaza) shall
be modified as required by the City Engineer to address those
concerns identified in the Tinter Associates, Inc. Transportation
Engineering Study filed in conjunction with this project including a
right turn only exit lane onto University Drive.
F. Prior to the issuance of Building Permits, Local Traffic
Impact Fees in the amount of $12,880.68 shall be paid to the City.

E TI : All Resolutions or parts of Resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
E TI N 4. If any clause, section, other part or application of
this Resolution or Development Order is held by any court of
competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions
or applications of this resolution or development order.
SECTION 5. This Resolution shall become effective
immediately upon adoption.
