CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-94 17
A RESOLUTION RELEASING A PERFORMANCE BOND
POSTED FOR THE WATER DISTRIBUTION SYSTEM
IMPROVEMENTS FOR KINGS POINT TRENT PHASE II
PROJECT; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, Lennar Homes, Inc., as Principal, with
Comerica, as Surety, has filed with the City performance
Letter of Credit No. 518287 in the amount $41,434.00 to
guarantee the water distribution system improvements at Kings
Point Trent Phase II; and
WHEREAS, the City Engineering Department has found that
the work has been satisfactorily completed and has
recommended release of said performance bond upon receipt of
a one-year warranty bond in the amount of $11,469.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
TAMARAC, FLORIDA:
SECTION 1: That the performance Letter of Credit No.
518287 posted by Lennar Homes, Inc., as Principal, with
Comerica, as Surety, in the amount of $41,434.00 for public
improvements at Kings Point Trent Phase II is HEREBY
RELEASED, subject to receipt of a one-year warranty bond in
the amount of $11,469.00.
SECTTQN, 2 _ All resolutions or parts of resolutions in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION3: If any clause, section, other part or
application of this Resolution is held by any court of
competent jurisdiction to be unconstitutional or invalid, in
part or application, it shall not affect the validity of the
remaining portions or applications of this Resolution.

SECTION 4: This Resolution shall become effective
