CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-94-__/ 9g
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, APPROVING
A MINOR DELEGATION REQUEST TO PLACE A
NOTATION ON THE FACE OF THE UNIVERSITY
HOSPITAL PLAT, ACCORDING TO THE PLAT
THEREOF, AS RECORDED IN PLAT BOOK 102, AT
PAGE 50, OF THE PUBLIC RECORDS OF
BROWARD COUNTY, FLORIDA, LOCATED AT THE
NORTHWEST CORNER OF UNIVERSITY DRIVE
AND NW 71 COURT; TO ESTABLISH A PLAT
RESTRICTION AS TO THE ALLOWABLE SQUARE
FOOTAGE FOR STRUCTURES TO BE BUILT UPON
THE SUBJECT PROPERTY; PETITION NO. 4-P-
94-; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, pursuant to the provisions of the Code of
Ordinances of the City of Tamarac, Florida, a public meeting has
been advertised in accordance with applicable code sections of the
date, time and place of the meeting regarding delegation requests;
and
WHEREAS, the City Commission has examined the application
and staff recommendation dated September 6, 1994; and
WHEREAS, the Director of Planning and City Engineer
recommend approval of this request; and

WHEREAS, the City Commission has determined that the
application is in compliance with all elements of the Comprehensive
Plan, or will be in compliance prior to the issuance of a Certificate
of Occupancy for the development that is the subject of the
application; and
WHEREAS, at the time the plat was recorded, Broward County
had no requirement that a plat notation was required to identify the
development intensity of such property, nor did the property owner
voluntarily elect to place a note on the plat to establish road impact
fees, and
WHEREAS, the property owner desires to establish a plat
notation to specifically identify the development intensity level
assigned to the plat by Broward County at the time the plat was
recorded, and
WHEREAS, the City Commission of the City of Tamarac,
Florida deems it to be in the best interests of the citizens and
residents of the City of Tamarac to approve this delegation request;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:

SECTION 2: That the City Commission hereby approves the
delegation request to establish a plat notation on the University
Hospital Plat, as more particularly described in the legal description
attached hereto and identified as Exhibit A. The plat notation
approved by the City of Tamarac is as follows:
This plat is restricted to:
Hospital - 330,000 sq. ft. (174,564 sq. ft. existing and
155,436 sq. ft. proposed).
Office - 155,000 sq. ft. (64,926 sq. ft. existing and 90,074
sq. ft. proposed).
SECTION 3: All Resolutions or parts of Resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 4_If any clause, section, other part or application of
this Resolution is held by any court of competent jurisdiction to be
unconstitutional or invalid, in part or application, it shall not affect
the validity of the remaining portions or applications of this
resolution .
SECTION . This Resolution shall become effective
immediately upon adoption.
